My husband was very sick and diagnosed with lung cancer during the first week whilst he was in hospital.He was then told to go to another hospital for more tests he was given 4 different tests he had to be given but was left as an outpatient.Was given no pain relief and not told that he could attend the hospital in an emergency and if he was in pain was told to take paracetamol. This he suffered for 3 days in real real pain and when I eventually managed to get him to go to hospital (this was private ) he kept saying I have an appointment made,thought he had to wait . I took him in hospital at 2.30a.m. for pain relief expecting him to be sitting up when I arrived he was heavily out of it on morphin and his arms and feet were tied. I did not know his feet were tied and as soon as we arrived they released his arms but I did not know that one of his feet were still tied. He died by 11.45 a.m. We were told it was because no one was with him???? Why were they not caring for him properly.

I cannot say whether or not it is illegal in Spain, most countries have strict guidelines regarding patient restraints. This has it's positive and negative points, which you do not need debated at this point. The more important issue is what was the official cause of death. Being left alone does not say why he passed. However, if he died due to respiratory depression from too much morphine (this is a common cause of death) then the restraints are not the issue, it is the lack of proper monitoring. Anyone with your husband's issues should have been on a pulse oximeter monitor to alarm if his oxygen level got too low. This is most important in people with poor lung function (due to cancer) and being given medications which affect the respirations.

first of all, deeply sorry for your loss. Second... seek a good malpractice attorney. i worked in a hospital here in the U.S for 15 years and there were lots of rules when it came to restraining a patient. One arm and one leg at a time can be restrained, and they have to be on opposite sides of the body. However,,, this may very well not be the case where you are, so have an attorney find out. Then, get the complete medical records from the hospital, if any problems your attorney can do this right away.

As far as him passing because he was alone???? Not sure why they said this, ask them "why do you say that?" squeaky wheel gets the oil, if you know what I mean. Also, you can request a sit down with a hospital administrator, demand it if need be. if he had a terminal illness, remember this...
we pray for the Lord to tkae the disease away from our loved one, when in fact the Lord has taken our loved one away from the disease.
