The number has not officially been retired. However NASCAR and Richard Childress have put a kind of moratorium on it, and have held it out of compititon as a show of respect for Dale Sr. I suspect that some day, there may be an official retirement. Or if/when Richard Childerss ever leaves the racing community, the number may go back into circulation. Hard to really tell. It is all just speculation...
To clear up a point, no one owns a number, NASCAR leases the numbers to the owners.

From my understanding of the hole thing the # 3 is still open to be used by Childress. If and when he chooses... But the Only Person/s he would put in the #3 again would be an Earnhardt.
Wether it be Kerry or Jr and u cant forget his daughter he had with Theresa. I also Agree it wouldnt be the same to see the #3 on the track without Dale sr behind the wheel.

Richard Childress is a class act and has paid for (or continues to pay for) the rights to the #3. He and Dale were very close friends both on and off the track. I would venture a guess that he will do what he can to see to it that nobody uses that number as long as he lives. What happens after that remains to be seen. I personally hope that nobody ever gets to race it again because it would be an insult to my memories of Dale Sr. I was a fan of his since the mid 80's and I do not think I would ever adjust to another person in a car with that number.

RCR has the rights to it and it has not been retired Do Dale Sr. Fans know that SR> used these #s 2--8--15? Also Srs DAD Ralph Used the #31 & 54 how many knew this and all the previously used numbers mentioned above are NOT RETIRED!!!!!

The number 3 is not retired though a lot of folks believe it should be. So if anyone wants to use it they can, but I think nobody will because of what Sr. did in it and what it means to the whole nascar community.

No the 3 is not retired but right now the 3 is still leased to Richard Childress. So it is up to him if he wants to use it, and he has said in past he doesnt want to use unless under right circumstances.

Whoever drives the 3 it won't be the same. Plus Childress said they only way he'll ever put the 3 out again is only for an Earnhardt and necessarily Junior.
