Hello, will give you story, then question/s.. Last night, around 3am, went to an all night garage for cigarettes, there was a group of 'neds' hanging around, maybe about 12/15 of them. I was minding my own business and just leaving when one walked over and punched me square in the face, after taunting me to fight back for while, he soon returned to his pals, police appeared soon and got hold of him, he was aged maybe 21-23, he was charged with assault and taken away, I gave statement to police and was checked out in an ambulance. Had a very bloodied nose which is agony but don't think broken, have a huge cut on upper lip and sore front tooth. Anyway, what is likely to happen to him? Will I find out? And, do I have the right to any criminal damages?( If yes, how do I go about this?) Thanks...

To be honest not much will happen
he will most probably be fined, and given probabtion
Prisons are far to over crowded as it is, the courts will see this as a minor charge ( although to you it obviously isnt)
He will also probably be ordered to pay you compensation, to which you will recieve £5 per month for X amount of months, because the pathetic excuse for a person will plead poverty, no job etc

first of all he was not charged with assault or anyting else for that matter.
He was arrested at the scene on suspicsion of assault. he was taken to the police station and interviewed re the offence and if the interviewing officer is satisfied that an assault as taken place the accused person will be identified by the police and if he as no previous convictions, a caution may have been issued. end of story. If he as previous convictions then he may be charged with the offence and depending on what was said during the interview he could be charged with various sections of Offences against the person act.

In any case a incident number will be made of the incident and will be available to you if you ask at the police station.

IF you wish to make a claim, you can but quite honestly a punch in the noseaint going to get you a penny so dont bother
even a no win no fee wont take the case if you dont believe me give it a try. the reason they wont is the person or company have to have the means to pay any damages and unless the bloke that hit you is a lottery winner you wont have any chance of extracting any money from him.
the criminal injuries compensation board will not even look at your case 3000 ppl geta bloody nose every weekend in the UK think about it dont bother. they only deal with cases of a more serious nature not little taps on the nose

and the advice given by the answer above mine is ludicrous and if he is actually a UK COPPER I will hand my warrant card in tomorrow

Basically, you need to give a statement about what happened (assuming you've not already done so) which is something written by the Police and signed by you as your account of the incident. Apologies if I'm stating the obvious but some people get confused by thinking that merely telling an officer what happened constitutes a statement, it doesn't.

The officer dealing will contact you to tell you that they are the officer in the case (OIC) and dealing with your complaint and should inform you of the outcome of the investigation. This is something that has to be done now under the government’s new victim code, which is designed to keep victims of crime informed of Police actions.

What happens to the delightful 'gentleman' will depend on the decision makers who will decide if the case progresses to Court and ultimately the Courts themselves, based on the evidence gathered by the Police.

It may be a fine or community punishment order or something similarly minor, as the courts don't seem to want to send people to jail anymore!

As for compensation, the criminal injuries compensation board should be able to help there. Follow the links kindly provided by other answers.

The offence committed is that of assault occasioning actual bodily harm (AOABH), which is section 47 of the Offences Against The Person Act. This is the next one up from a common assault (section 39). The injuries caused dictate that this should be a section 47.

As the male has already been charged then a court appearance is imminent. If he pleads guilty then he will be dealt with, I suspect that to be in the way of a fine. If he pleads not guilty then a trial will follow. Likewise if he is found to be guilty then he will probably receive a slightly higher fine.

In terms of compensation; the courts can award you compensation if the male is found to be guilty. If you are awarded anything it will only be a small amount £50 - 200
(I guess). You could check whether you were eligible to claim through the CICA (Criminal Injuries Compensation Authority). I have attached a link to their site, but don't expect vast sums of money, if anything at all.

Did the police arrive because CCTV reported it as it was happening. Because if thats the case then evidence is present.....evidence is the main decision maker in do they prosecute or not.

Once the case has reached CPS they will decide if there is a good case to prosecute....if he has previous then yeah they probably will....if no previous is found and the CCTV is not clear enough then he probably get a caution

You can apply to the criminal injury compensation scheme (he does not need to be prosecuted for you to apply)

check out Breech of the peace - it will tell you what the sentence will be, probably few months in jail, I dont think you will get anything if you put in a claim but try The Criminal Injuries Compensation Board. My partner recently had an argument with a work colleague and was arrested and charged with Racially Aggravated Assault, he never done anything and his lawyer told him it Will be down to Breech of the Peace, few hundred pounds fine

You will more than likely go to court to give evidence. Go to the criminal injuries website and download a form, or tell the police you are claiming compensation, they should be able to give you a form, it will also get the one who hit you a longer sentence.

he'll get a 6 month suspended probably and a fine and probation. hes probaly on cctv. in court his name and address will be given. so forget damages hes more than likely never worked a day in his life and find him with your mates and give him some damages. but you may be able to claim something of the home office

If there is no CCTV or other witness' then he will not be charged, afterall, he has 11-14 other witness to say he didnt do it.
Regardless of whats right, the law always supports numbers and these cocks hang around in big groups.
He will be let off with at the very most a caution.

not exactly sure what will happen to the ned.
may he at least be punished properly but don't hold your breath.
you can ask the police to keep you up-to-date with the prosecution process but it maybe at their discretion.
contact the Police & ask for the address of the Criminal Compensation Board.
you should be awarded compensation for the trauma you've suffered.
