who is at fault?

i was travelling down a road and a woman turned right in front of me coming between two parked cars waiting in stationary traffic

i was in a no car lane when the accident happened i was travelling at the speed limit and in a straight line

her insurance company has accepted liability but a police officer is charging me with driving without undue care and attention, surely it was the third party who was driving without undue care and attention by not wauiting to see if there was oncoming traffic

getting charged with section 3 of the road traffic act 1998 and schedule 2 to the road traffic offenders act 1998

i would like opinions but also cons of the charges being brought against me and what i may expect in court if found guilty

and if posssible the meaning and definition of both charges

this case is to be in a uk court

My opinion is that you and the other driver will both be charged with contributory negligence; that is, both of you should have been more careful.
It would have been more prudent of you to stop in the traffic when you saw the other parked card vehicles, and it would have been prudent for the other driver to stop before trying to take the turn.
Legally, I believe that the other driver has more at fault than you, since she did not yield to oncoming traffic, however.
If there is a court case out of this, use the fact that the other driver did not yield to oncoming traffic.

Request a hearing in traffic court. If the officer testifies, get him to say he was not an eye witness. Then ask that the charges be dropped.
