if my biological child got into my car and without my knowledge and hit another car while I was visiting him in a foster home and I am not his legal guardian and do not live with him or have any legal resposibility to him as decided by the court, am I responsible for the damages?

Your car was not locked? Keys not in your pocket? If the answer is yes to either of these questions, then you are responsible due to neglect.

It doesnt matter....

Someone has to take the responsibility of the damage made.
Which leaves the choice of "YOU" or the "CHILD".
If you decide to take the responsibility for not locking ur car or take ur key w/ you, you are at fault, and will be dealing w/ the insurance co.

If you blames the responsibility to the Child, then the Child would be under the charge of "Theft", steal ur key and car.

It could go either way, but someone has to take the responsibility, You or the Child. If you sucessfully blamed the Child for Car Theft, then his Legal Guardian would have to standard out for the responsibility and pay. depends on the Age of the child

Yes, because if any child got into your car and hit another car while you were visiting, you would be responsible - that is why you are required to have insurance and are supposed to lock cars and take the keys with you.

One very important question for you. DID YOU REPORT THE CAR STOLEN AS SOON AS YOU REALIZED HE TOOK IT? If not, you are legally responsible and if you are inusred you insurance company is compelled to pay. You may see a rate increase due to what is called a Lending Loss. Talk to your insurance co.
