when a cop tells you to shut up. do you have to or since freedom of speech can you still talk?

It depends on the situation.

In some circumstances me telling you to shut you, is very unprofessional and has no real reason apart from the fact I don't want to hear what you're saying. Maybe I had a bad day... Its unlikely in this situation that you would get a charge.

In other situations, where I can articulate that your continued speech (usually drunken) represents a danger to myself or others, or is preventing me from doing my job I'll charge you. There's plenty of different charges that apply ranging from disobeying a lawful order, interference with a police officer, harrassment (if your comments aren't directed at me), inciting a riot....etc

You have to SHUT UP if the police officer is telling you to do so, if for example he is apprehending a suspect and you are just aggrevating the situation of yelling every now and then for the suspect side of the case, if he/she happens to be a friend.

The police is the symbol of law and order, and if you donot obliged to the officer then you are in considered a breach of peace and could also be considered hostile by nature and could be hauled to jail together with the suspect in custody.

The more you talk after being told by a cop to shut up, the deeper a hole you will dig for yourself, and if you KEEP talking, that hole will get so deep you'll never be able to get out of it.

My best advice is to shut up when he tells you to. Without listing statutes and laws (which vary from state to state) you're just asking for a free stay at the local jail.

Depends. If you really are interfering with or hampering my investigation I can cite or book you for it.

If you're just a loud, sober, AH, I'll shove you in my police car until I've finished what we're doing.

So I guess the answer is if you want to risk arrest.

I'm not a cop but I can tell you that if it interferes with a cross examination of another party that is involved than they can arrest you for interfering with an investigation.

If you value your life, I would. Not cooperating results in a ton more fines including persistent disorderly conduct. Also keep in mind that the officer you are harassing also has family and friends just like you do. He is just doing his job. You can ask questions, just don't be rude about it

Most people that need to be told to be quiet don't have enough sense to keep themselves from saying something that will give me reason to put them in jail. So I'm usually telling people to be quiet so that they don't end up in jail.

Cops can do what ever they want. I'd shut up. It will make him feel really big if you mind him. You don't want to say anything to a cop anyway. If your getting arrested say nothing absolutely nothing.

if an officer tells you to shut up,your safest bet would be to shut up.especially if they aren't speaking to you.
