sometimes when I go to the convenient store I get taxed on it when I buy a coffee and some cookies. so I get confused. I know prepared food is taxed such as donuts or a breakfast sandwich but what about junk food (candy, chips, cookies, nuts etc.)

sometimes I'm told that it's taxable sometimes they don't tax me.

If it helps I live in houston texas.

Thanks.

It depends on the jurisdiction. Here in California unprepared food (you cook or eat right out of the package) is not subject to sales tax but prepared food, restaurant food, supermarket deli food ready to eat including take out, soda, and liquor are subject to sales tax. Candy and snack food like chips and doughnuts are not.

What is taxed depends on state law, but should be consistent from day to day or from store to store for the same item.
