here's the situation
couple A goes to look at an apartment on Monday at 4:30ish
they like it, and as they're leaving, the woman showing the apartment says "well, let me know if you decide you'd like to rent it"

Noon rolls around the next day, and the couple A has desided they'd like to rent the apartment, so they call the lady.

She has already rented it out to couple B whom she showed the apartment to Tuesday morning.

While I would fully understand her wanting to rent the apartment as soon as possible (even though the current renters aren't moving out until the end of the month)
...is it wrong of me to think that she should have given couple A (which obviously includes me) at least a day to deside?

she actually just called and said "I thought about calling and asking you if you wanted it while they were here"

and she said "if anything falls through, you'll be next in line"

so I think she feels bad about it....

and to respond to a couple things....this is not in NYC...it's a city that is only a couple hundred over the population needed to qualify as a city
and I never asked anything about the legality of the situation....

the question was also mostly to vent my frustration

She "should" have waited, but this type of thing really is a first come first serve deal. It sucks, but people are quick to make decisions and give it to whomever seems the most eager right away.

Sorry, can't say that I agree with you. It some places its hard to find apartments, the best bet is to put some sort of deposit down for them to hold it until you decide. I've lived in a small city in New England that had a housing crunch, when you went to look at an apartment you usually had to give the person an answer before you left the Apt you were looking at or deal with the fact that an hour or two later that apartment might be rented to someone else. Sometimes you weren't even the only one looking at it at that time, had a little group Apt tour. Might be different if she decided to charge you an application fee prior to looking at it....

I think that it is first come first serve that should be the basis. One day is not a lot to ask and the landlord can always tell couple B that they are waiting to hear from you and if they don't then it can be couple B's. Hopefully you have better luck next time and maybe mention this to the next landlord so that it might not happen again and show how interested you really are.

Nope, sorry. That is what capitalism is all about. Until you agree to buy it, she has the right to sell/rent the product to whomever she chooses. She made no promise to hold the apartment for you, and you did not request that she do so... and even then, if it isn't in writing, it doesn't legally count.

So yeah, it sucks for you, but it is fair.

i think if u truly wanted the apartment and didnt want her to show it to anyone than money talks. you should have left the minimal amoutn of money for a deposit so she wouldnt show it to other renters. if they were willing to sign papers and pay money then couple b is more entitled to the property bc they actually did something about it. thats the way the real estate world works, money talks!

check with your tenant resourses via the internet... Her actions seem almost discriminatory. guess you should have called at 9:00 a.m.? She needs to get renters etiquette down. Best of luck on your search.

I went from a house to an place of residing and that i like it. yet some human beings i understand might extremely stay in a house. you do get greater freedom in a house. A backyard and extra area. i might decide for it if I have been you.. a minimum of for the sake of the toddlers..

In a perfect world yes...if you had already put in an application, been approved and she had your contact information. More often than not they rent to the one that is there and has the money.

That was a cheap thing to do.They prob payed deposit on the spot.Still a cheap thing to do.As they say money talks.

She should have waited. She should have said that other people are looking at the apartment, and she'll let them know who she decides to rent to.
