What do I do if I encounter police while on legal drugs? Most of them are probably to dumb to know that there are legal drugs, but some of them are pretty good at recognising stoned people, so if im stoned on legal herbal marijuana (like spice), or on other legals, what can I do to make the police go away?

There are legal recreational drugs, pills, herbal mixes, you can even get a legal cocaine substitute called subcoca i think. There is no perscription involved, and I dont drive while under the influence of anything, and never cause trouble. You buy them from headshops, and most can't be used for medical purposes, as having a perscription drug when you arent on that perscription is a class C offense. I am talking legal drugs that you buy from credible shops for the purpose of being recreational. It appears lots of people other than cops dont know that there are legal recreational drugs other than alcohol and tobacco (many of which are safer than both.

People are drunk all the time, and even when they are ridiculously wasted, if they arent causing trouble all the police usially do is give them a lift home so they dont harm themselves or get lost. Noone gets charged for being drunk, if they dont cause trouble, i mean, loads of people walk home drunk every friday night.

If you are intoxicated and in public you can be arrested for that regardless of the legality of the drug involved (alcohol is legal). Additionally, using many substances in a manner that is consistent with the label instructions and warning can also lead to arrest (think sniffing paint or glue here).

If you are detained the substance will likely be tested to determine if it is indeed an illegal drug. Once it is found that it is not, you could be released. However, if you are carrying it in a manner that is consistent with street level sales (spice in little individual baggies) you could face trafficking charges anyway as many states include counterfeit drugs in the trafficking laws.

If you fail a field sobriety test, on legal medications or not...you can be charged with being under the influence.
Perfect examples are people on sleeping aids or pain medications who's bodies react to the drug. If you are driving or in public causing problems, you can be charged...even though you are on a prescription.
So, the answer is yes, you can be arrested for being "legally" stoned.

If you are not causing trouble or driving under the influence than you should never have to worry about encountering police in the first place.

These herbal mixes and substitutes as you put it often contain a controlled substance. It may be legal to sell them (although I doubt it), but that would not change result if you were tried for possession. When someone is prosecuted for possession of a controlled substance, the substance is analyzed for it's base ingredients. If any of them are controlled substances, then it is a violation.

the police would probebly take the drugs to get tested and when it shows up there is no thc in it they would not charge you, i doubt the police would say anything if they could just see you were stoned, i have talked to the police in much worse states than that
