Should this ever be classified as an accident? What kind of punishment do you see as necessary, if any?

These stories are so sad. I read in the newspaper a while ago a story about a dad who was driving his baby to preschool. He was really tired, he had been up really late the night before, and the baby fell asleep in the back seat. He forgot he hadn't dropped the kid off at preschool and he drove straight to work. The next time he went out to his car the baby was in the back dead.
The judge ruled that it was an accident and he wasn't prosecuted. I agree with that ruling because it sounded like it really was an accident, and you know that the guilt that that father must be feeling is a hundred times worse than any punishment the court could give to him.
In cases of knowing neglect however, like if a parent leaves their child in the car on purpose, and thinks "oh it won't get hot enough to hurt them" and it does, then I think they should be prosecuted.

If it was truly an accident I'm not sure if there should be any punishment. If there was intent to hurt or just plain negligence then it may be a different story. I have heard of a couple that did just that but it was an accident I believe. It is a very sad thing, I will keep these people in my prayers.

Two different tragic true stories I heard about, similar outcomes:

1) A man who usually drops off only his older child at school was also asked by his wife one day to drop off their baby at day care first. Well the baby was asleep and he completely forgot about him; took the older child to school, then went off to work -- his normal routine. When his wife went to pick up their baby, obviously the baby wasn't there. She called her husband and that's when he realized he had forgotten all about the baby. He was obviously overwhelmed with grief. I don't think any charges were pressed. I believe this to be an unfortunate, but tragic accident.

2) A woman who had two young children in the car with her left them in the car for about two hours while she did some shopping and got her nails done. When she came out and found that they had died, she freaked, obviously. She drove around for another two hours trying to figure out what to do. Finally she ran to authorities claiming she had been raped and her car stolen (or something similar to that). Eventually they got the truth out of her and she was charged with either manslaughter, or possibly even second-degree homicide. (Can't remember details, it's been a while.)

This is neglect. But this is one instance of various forms of neglect evident in our society lately. There are many.

Every time I see children 3 to 5 years old playing out in busy streets I think of neglect. Letting our children be raised by the garbage on t.v. is neglect. Letting kids listen to what they want on the radio is neglect. Especially when I hear kids a few years old riding bikes singing "my back, my neck...". Or let them play alone with vicious pets. And allow them to wear clothes made for adults seeking sexual attention. These and many more things SCREAM neglect.

Parents are so absorbed in their own pleasure and childish self centerings they no longer no how to raise children.

It is neglegience, it is being an unfit parent, it is being stupid. It is murder! I think they should be punished to the full extent of the law

All these people who say well if it was an accident than.....? How the hell could it be an accident?! People, how can you forget about your children? How? I don't understand. People that can are obviously not fit parents.

This is child abuse. If the child died the parents should be held accountable to the full extent of man's law. If not punished by man they shall receive judgement in the end of days.

Yeah, I just don't understand how someone can forget where there child is...I have seen where older children climb in a car of their own volition and then be unable to get out...around her two kids locked themselves in a trunk and no one could find them...it's all really awful.

It's neglect, not an accident, and should be punshible to the full extent of the law (manslaughter or whatever the charge would be.)

As sorry as I would feel for the parent (and more so for the child), we all have to pay the price for our actions wether they be mistakes or not. Actions have consequences, good and bad.

No one should leave their kids in the car when it's hot for a long period of time. I don't understand how doing so could be an accident. Unless you really are very stupid.
