In February 2005 a speeding taxi driver drove into the back of my minibus. He then got 2 of his friends to give false statements to say that I had pulled out immediately in front of him and slammed my brakes on. (That was a lie, and there were no witnesses to the accident at all)

Next he served me with a claim for £11,000. damages, including whiplash, even though it was his fault. I protested this and insisted on it going all the way to court.

In court the judge had to warn him about his constant lying, and he ending up dropping his case before they could find him guilty of being in contempt of court. It turns out this was the 4th time he had sued somebody for back and neck injuries that were his own fault. (Although he couldn't remember any of these incidents in court!)

Anyway, the short of it is his insurance company were ordered to pay £5000 of my costs and £480 damages to me for my minibus back step. He had gone to a no win no fee company.

I was paid for my damages, however I have found out today that his insurance company refuse to pay for my defence costs, and offered £1000 towards my counterclaim costs only.

MEANING....... that the other £4000 of the claim has got to be paid by him!
(I had had confirmation of this from my insurance company)

HA HA HA HA HA!

He has offered to pay it off at £20 per month for 16 years but now my legal team are taking him to court for a claim on his property!

Oh what joy? I bet he wishes he hadn’t got out of bed that morning.

Thank you for that advice Canute. But the shoe could only be on the other foot if I one day attempted to make an illegal claim against somebody when I knew it wasn't my fault, and asked friends to commit perjury to help me. Something I know i will never be doing.

Yes cgriffin1972. he owns his own house and has just had 2 extentions put on it. (I did a lot of research on him and uncovered his planning applications on the internet.) Interestingly enough, the plans were put in 7 days after the accident and I phoned his architect who told me that he had shown him round the house perfectly fine on that day, at the same time as he was claiming to be crippled with whiplash!

Crystal, he was found at fault in court, and the judge ordered that his side should pay my damages and legal expenses. He had gone to a no win no fee company and had taken out insurance with them to cover the legal costs if it he lost. But now they are saying they will not cover my defence costs, only my counterclaim costs, meaning that he is responsible for the rest. I'm not sure why his actual car insurance company aren't involved. I can only presume that they wouldn't persue such a rediculous case, whereas these despicable personal injury specialists take on any old case and know they will get paid because of the insurance their customers have to take out with them incase if they lose. My insurance company would only be responsible for my costs if I lost.

I seen a TV Commercial here in the USA froma Allstate Insurance co. I am wondering if that is not Insurance Fraud like scoop and squat . You may wish to find out if there is a Insurance Fraud Hotline .

I put in some sites you may wish to do a search in your home country for insurance fraud, I know in the USA there are licensed private investigators who go after fraudsters, of all kinds, some are former policemen, some run a agency hired by or owned by a insurance company.

who said "by their lies you shall know the truth" When working as a clerk in a lawyers office. I was always told. " Do not lie, if you lie even a small lie your case is weak and if the lie is discovered and it is likely that it will be the whole of your case will be discredited, If you are wrong say so and correct it, you wil at least retain some credability. it wil cost but no here near as much as it wil cccost if you are found to be lying. The Lord Black case in the States brought that back to mind

A Star story, about time someone stood up for themselves, I witnessed an accident several years ago and the offending driver tried to wriggle out of it, it was'nt him driving, it was his wife, the other driver cut them up, loads of excuses, the person he hit suffered life threatening injuries and was very ill, some how he got off with it, never been more suprised in my life, as the court believed him instead of 3 independant witnesses, saying there was some doubt about the identity of the driver.

I'm very happy for that you stuck out this claim, alot of people are put off by all the legalities. Just goes to show if you stick to your guns it will all come out well in the end
