And spends 99% of the time free outside with me, dogs belong outside not cooped up in a house. (we have come to an agreement with the other owner who keeps his dog outside on a chain too) to pay half each thankfully the morning after pill was perscribed.but we both wondered who would have been liable.

your dog was tied and on your own property, its is the owner of the other dogs responsibility to keep his dog home and contained, as long as you were obeying the leash laws and such its the other persons responsibility, i dont like having a dog on a chain either but as long as it gets loose enough to have its exercise and run around with you in the yard you do what you have to, next time though id suggest a kennel because dogs will come for MILES to get to a female in heat and if its not a neighbors dog its going to be some stray someone kicked out and then its ALL your responsibility because it is no ones dog.luckily it doesnt sound like the neighbor wants to be nasty about it and is willing to cooperate, and for all these "experts" on here...they can do dna testing on the puppies the same as they do on humans an find out who the sire is if the parties involved want to take it that far.
people need to read questions better, first off her dog wasnt roaming around while in season her dog was contained on her OWN land, thats all the law commands, that alone makes it the other owners responsibility. she asked whos fault it was legally not for opinions on how it happened or how she keeps her dog.

It's your dog and you are the one who let a female in heat outside unattended.
Sorry. Not to be rude, it's just one of the downsides of having a female in heat.
You may be able to talk to the owner of the male, but ultimately, it's your dog and your responsibility.
EDIT:
I know I'm not going to change your mind on this one, but I would like to point something out. If she is a guard dog, and is changed to her kennel, she can only guard the area she can reach on her chain. I have a 3000 SQ FT home of which 3 of my 5 have full access. (2 are crated right now). I also have over an acre fenced. My dogs are guard dogs in the fact that no one would ever enter my home hearing all that racket (barking) and seeing them - which they can throught the windows etc. They are outside when we are and inside when we are. Funny thing is, they want to be where I am no matter what - ALL 5 of them even if it's in the bathroom. They are thrilled to watch me pee. They like being outside but they would much rather be with us - no matter where that is.
Just food for thought, that's all and not trying to be judgemental.
And to your original question - if you are going to have an unaltered female, you will have to leash walk her or this will happen again. Most likely, she has been impregnated by several males before this one. I know you watch her but it happens quickly and if you leave her tied outside, it will happen repeatedly. All the boys in the neighborhood will do anything they can to get to her.

How are you proving the dog that came into your yard was the one that got your dog pregnant???
Why did you allow your dog to be outside without supervision when she was in heat in most places you are totally responsible to keep a female in heat under control and you are responsible.
What vet bills???
You do realize that a female can be bred by more than 1 male so the best you can do is to have ALL the pups and this male DNA tested then if you can get a lwayer and prove it was that male and depending if there is a leash law you may be able to do something.Where I live there is no leashlaw and you are responsable to keep teh female from any males when in heat so therefore you would be totally responsable

A year ago, one of my Yorkies (Teddy) was to be mated with a little female of the same breed. The female stayed with us for the day but, when it came to it, there was NO way she'd accept Teddy's advances! Her owner had to take her home. Following that disappointing day, Teddy would not settle. He was off his food, he'd walk about all night, he stopped playing. I think your dog has 'expectations' which are not forthcoming and, therefore, he is slightly off-colour and behaving strangely. It will pass. Plenty of exercise to keep him fit and a few tasty treats should do the trick in time. I know one panics when a pet won't eat but, as long as the vet is satisfied nothing is wrong, it WILL get better. Your 'boy' is love-sick, that's all! Give him a big hug!!!

Yeah, if your female is in season, don't keep her outside to antagonize the males in the area.
An old neighbor of mine did that and my dog actually chewed clean through his tie out to get to their dog 4 city blocks away. Sadly, he was hit by a car and killed.
I could have been a pain and asked if they should be liable for my emotional distress and property damage, but then I'm not like that. I realize that animals have instincts, and will act upon them. Sometimes both and sometimes neither of the owners are to blame.

You left her exposed. The male is just a dog at large fine. You are the least responsible for haveing a dog in heat. Males get out and come there because the female is tied in heat. Kind of like the goat on jurassic park you left her there as bait.

I'm no lawyer, but I would say that you are still liable. It is your dog, and as such you chose not to spay her. So if she got pregnant while in your care, you must accept responsibility. Unless you know the owner of the male and can work something out, but it'll be pretty hard to prove who is the sire.

you because you were dumb enough to let your ***** roam around whilst in season!!
A dog will do almost anything to get to a ***** in season and if it means jumping the fence into your garden then that's what he will do!!

being chained to a kennel does not make a difference!!!
She should not be left unattended, better still she should be indoors
You say you spend 99% of time with your dog
Well when shes on heat that should be 100% unless she is indoors

Besides all the very good answers provided already, why in the world do you have your dog chained to a kennel outside? Do you even like your dog? Sounds like your dog would be better off if you surrendered her to a rescue group. Get a clue!!!

I would assume you are. You should have taken proper actions to ensure that your dog wouldn't get pregnate. You could have put her in a fence or a kennel until she was out of heat. You really need to have her spayed if you don't want puppies. Having her spayed is also better for her health.
