There are a couple of factors to consider before stating whether an offense of carrying a weapon warrants serving jail time or just a fine!
In most states carrying a concealed weapon (CCW) without a permit in public is a misdemeanor offense and can be punishable up to one year in jail, however, normally there is just a fine, court costs and fees, and probation.
There is also, however, a federal law which prohibits convicted felons from possessing any firearm or its ammunition. If convicted in a case such as this an individual can serve up to five years in federal prison.

The government introduced a minimum five-year sentence for people convicted of possessing an illegal firearm. This is obviously for possessing the genuine article and not imitations (BB guns) or air weapons.
It is also an offence to possess an air weapon or imitation firearm in public without legal authority or reasonable excuse.

It depends on your state, but here it is for Texas....
§ 46.02. UNLAWFUL CARRYING WEAPONS. (a) A person commits
an offense if he intentionally, knowingly, or recklessly carries on
or about his person a handgun, illegal knife, or club.
(b) Except as provided by Subsection (c), an offense under
this section is a Class A misdemeanor.
(c) An offense under this section is a felony of the third
degree if the offense is committed on any premises licensed or
issued a permit by this state for the sale of alcoholic beverages.
And the punishment for a Class A misdemeanor is....
§ 12.21. CLASS A MISDEMEANOR. An individual adjudged
guilty of a Class A misdemeanor shall be punished by:
(1) a fine not to exceed $4,000;
(2) confinement in jail for a term not to exceed one
year; or
(3) both such fine and confinement.
And the punishment for a Third Degree Felony is.....
§ 12.34. THIRD DEGREE FELONY PUNISHMENT. (a) An
individual adjudged guilty of a felony of the third degree shall be
punished by imprisonment in the institutional division for any term
of not more than 10 years or less than 2 years.
(b) In addition to imprisonment, an individual adjudged
guilty of a felony of the third degree may be punished by a fine not
to exceed $10,000.

Well it depends. If you are legal to posses a firearm, and you are following all the laws, then nothing. But if you have a gun and you walk into a bank or something, expect some prison time.

If you are someoneone with no previous record, you may be charged with just a misdemenor. If you are a convicted felon,it is a federal rap with 5 years minimum in the fed. pokey.
