A capital one card was opened without my husbands knowledge. He called and they sent him a letter saying he was not responsible. So they changed the account number and keep sending him a bill. We have called and sent copies of the letter etc... What do you have to do to deal with them. UGGH!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! I really don't want to pay the bill, but we are trying to rebuild our credit and don't want it destroyed either. Fraud Protection What a joke.

I hope your husband filed a police report. If he hasn't, he should
I also hope that every letter you sent to Cap One was sent certified mail return receipt (paper trail)
You should quit speaking to them on the phone, you will have no record of what is said should you eventually decide to sue. Do all of the correspondence by mail


If you have been dealing with a certain person with Cap One, send another complaint and cc it to the CEO of Cap One - Richard D. Fairbank

If they continue to fail to correct the problem, send a complaint with a copy of the letter(s) Cap One sent to you, a copy of the police report, copies of the letters that were sent to Cap One and copies of the green certified mail return receipt cards that Cap One signed for, to your AG, the Virginia AG, and the Bureau of Financial Institutions of the State Corporation Commission of Virginia.


If Cap One still refuses to correct it and once you have a solid paper trail proving that you have done everything possible to get it corrected, you might consider filing suit on them (you definitely would not be the first, or the last, to sue them for their violating actions)

Order your husband credit reports to make sure that bogus account is not reporting. If it is, dispute it.

Capital One did the same thing to me and I sent them a copy of the police report. Now they just won't talk with me and it is still on my credit report. For all of you with Capital One cards get rid of them, or hope that you never have a problem with fraud!

Report it to the police as ID theft then when you get the report send a copy to Cap1. They will investigate an remove the charge IF they find your denial is indeed correct.

Without the police report you are fighting one of the nastiest cards out there.
