Her father has physical custody and refuses to let her live w/me. Can she move in with me when she turns 17 without any one getting into trouble with the law?

You can address the Courts anytime you want to in regard to your daughter's living arrangements.

In fact, legal age for a child to make his or her own decision about where they live is 12 or 13 in most states.

Maybe you can get a free consultation with a paralegal or attorney. Many offer this service.

Or talk with the child support bureau in your county and ask.

I think it depends on, 1: what state you live in, and, 2: your rights as a mother been legally taken away. If the answer to number 2 is no, then the child could legally come live with you now, all you'd have to do is take the father to family court and petition him for custody, and depending on how old your daughter is now, she could legally tell the judge that she wants to live with you. In NY I believe the child can do this at the age of 13 or 14. Keep one thing in mind, however, if the child feels like she's having to chose, she may end up feeling guilty for abandoning the parent she ends up not living with. you can take it to the court and ask the judge about it...has ur daugther been trouble with the law
