Are you sure he was not also drunk or stoned at the time? There is no reason why a soldier on leave from Iraq would not have money for a hotel room, when I was there they would only let you get $250 of your pay. Police normally would not just arrest a soldier for doing that, they might give a ticket and tell him to move on but usually they let soldiers get away with little stuff like that. Now if the cops came up on him and he was drunk and belligerent with them, that is another story.

Probably not. The soldier in such a situation was probably arrested for a violation of some city ordinance as opposed to a criminal statute. It will probably be cleared up with a fine, if that much and nothing more. Once the solider returns to Iraq or as soon as he returns to post, he should make an appointment with a legal assistance officer (JAG) and get some legal advice. It may be a letter from an Army JAQ explaining the situation could clear the whole thing up.

I'm not even sure they were within their rights to arrest him, depends on the location and all the details. But it is very unlikely to get booted from the Army if that is truly the complete story and there was not resisting or anything like that. They are pretty desparate for troops, so they have sent guys back who have had diagnoses of PTSD, serious illnesses and so on. I don't think they would boot someone for this unless there is a lot more to the story or he had a pattern of problems.

No that is not that big of a deal though he should have at lest got a hotel room. I mean they do pay the solders and he should have had some money. I would punish him a little if I was his C.O. I mean it does look bad. But no they would not kick someone out of the army for something like that. Gee if they did that over such a small thing over half of the people in uniform would be booted out of the army.

This seems like a minor transgression. It might call for a bit of a pocketbook check and a filed disciplinary action notice, but unless the soldier had other transgressions on his record, I could not see it calling for a boot.

It's a civil misdemeanor at best. No jail time. Just a fine. I doubt the Army would consider administrative processing and discharge for that.

For something like that,no. In fact if he were to call his TDY base they could probably get him off. He should know what that is.I don't know if it's different now but he belongs to the US government.The civilian authorities really have no jurisdiction over him.Altho they can throw his butt in jail until it's all straightened out.

NO he would not be kicked out, but don't tell me he had no money to get a hotel to live in. I tell you what I would do if I was on leave and didn't have family to go home to. I would travel to Austrailia or Scottland... somewhere cool.
...jeeze can't even buy a hotel room? What had he spent all his money on to not be able to get a room?

no he wont get kicked out of the army, no need to worry about something soo petty as that. Its getting more and more difficult to get kicked out of the Army.
