Because E&M Motorsports already is using the number currently.

Joe might be in another car, but E&M still retains the current lease on the number. I have not seen HMS even show interest in the number.

The 08 is currently being used by another team. And no 3 number combinations are allowed in NASCAR.

I asked that same question but yea E&M Motor Sports owns it and Joe Nemecheck drives it eventhough lately he has been driving the #78 car
