if it's self defense it's not considered Murder.
Murder is the taking of a life without justification.
Justifiable homicide or self defense must exist as a way of protecting ones right to self preservation.
If You are attacked and are clearly in danger of being killed, shouldn't you be able to stop that person from killing you?, What if it was the only way to stop them?

If a human, or otherwise, has every intention of taking your life from you, and in fighting to Maintain your life you take theirs, it is justified that you were protecting your rights, while it would be shown the other human was breaking the law.
By all means, however, you do have the right to NOT fight back, and let someone kill you. Then, you will have saved a life. Not yours, though.

Murder is never justified under self defense---the use of appropriate force in defense of your own life is, up to and including lethal force...it's not murder.

Its not murder legally speaking, or it may be considered justifiable homicide. The rules for self defense vary from state to state, sometimes you literally have to be pushed to the wall with no other way out, other states its only if they are already in your home, one leg out doesn't count, so drag them in before you call the cops.
Its supposed to be a you or them scenario.
You can protect your family, but not your goods.
and of course yourself but you have to either be or feel threatened with death.
As I said, its a state to state definintion.

Murder is the unlawful taking of a life. If you are defending yourself and you take a life the claim of self defense could be offered and a finding of justifiable homicide may ensue from the claim.

Self defense is NOT MURDER, murder is a premeditated act, self defense is protecting your own life, or that of someone else.

It's not. If you're being attacked by someone and you kill them, you can still be put in jail. The only case in which you're legally allowed to kill another human being is when killing them is the only foreseable way to survive yourself. By that point, it's no longer murder.

why would you let someone kill you?...At the instance that the incident occurs i don't think the defend has time to mentally negotiate the consequences or benefits of killing his/her attacker and preserving his/her own life...it's something as basic as survival and should be excusable by law because 1 they did not instigate the fight and 2 they're only protecting they're own life; an instinct shared by every form of life from the queen of England to a mushroom

I don't know if justification is the word you seek..If someone tries to take your life I hope you do everything within your power to protect yourself...it is called survival.
