Police officers cannot arrest illegal aliens unless they have violated some other law. Some police departments have been trained by the federal government to do immigration screenings, so if they arrest someone for another reason and then that person turns out to be an illegal alien, they can hand them over to ICE.

But no, a police officer cannot arrest someone for the sole reason that they are an illegal alien.

No...the illegal alien must commit a crime other than simply being an illegal alien. My dad has had to let many illegal aliens go because he cant arrest them just for being illegal.

Absolutely. They can arrest a person for breaking any law be it local, state, or federal. However, a lot of police departments, for various reasons, have enacted policies preventing their officers from arresting illegal aliens unless they do something else.

Police officers can detain illegal aliens and call immgrations. Immigrations decides what to do from there.
