Me ... I can't understand your writing, are you sure you're a law student? The issues you (attempted to) identify are straw men. Once a baby is born, it is a "human being" (pursuant to Model Penal Code § 187), and causing its death can be a homicide. Prior to birth, the abortion procedure that would have been available to the mother, is considered an "elective medical procedure," and is legal, pursuant to Roe v. Wade. Obviously, Roe has been limited in many states (most notably in 'Casey v. Planned Parenthood'), but these basic definitions and concomitant actus reii still control your question re: homicide.

If a child is killed before 4 months pregnancy then it is not a human being because it doesn't have a soul. Therefore it doesn't go to Jinnah or Jahannam(Heaven or Hell) because it doesn't have a soul. If it is killed at 4 months or after then it goes to Jinnah. Roe admitted that she was never raped and that she lied at the time. Now she is trying to get the law overturned but the Supreme court says it is too late for her to change the law. She is now pro life. Just wait until one of the Evangelical Christians becomes president. Then abortion will be illegal(As it should be), homosexuals will be allowed to be targets of hate crimes, women will be told to stay in the home and have babies, and lots of other things will happen in the USA.

I personally would never have one, but I can be glib about that seeing I am male. But no one should have the right to tell a women who has no idea how to raise and care for a baby that she cannot have an abortion. With the proliferation of drug addicted women having drug addicted babies or babies with health problems I often think they are doing the baby a favor by not forcing them to live a life that less than others. Not many babies are adopted when they aren't perfect, so the concept of these babies getting a life with loving parents is very doubtful.
So this is one of those damned if you do and damned if you don't scenarios!

Because it is called "legalized murder" by those who truly believe that it is murder.
We protect the whale, we have laws to protect the eggs of certain species because they may otherwise become extinct, and we even have laws protecting the guilty. Even the death penalty has been mostly removed.
And yet, we have this barbarous method of killing innocent unborns just because the mother carrying the infant wants out!
Abortion is NOT a means of birth control just for the convenience of the mother's life style!
And it is NOT a cure for rape, either, because abortion has NEVER removed the pain of a rape - it only adds the pain of guilt to the pain of the shame!
And abortion has NEVER healed a cancer patient!
If one were to take the time to actually STUDY abortion, it's methodology, etc, one would see for him or herself how very ugly abortion truly is to the unborn baby who already has blood at 6 weeks, and nerve endings that actually FEEL pain not too much later!
And if abortion is OK, then why, if a pregnant mother dies, or loses her baby to a gun shooting or some other form of violent crime, is the guilty party charged with murder?
It looks like a double-standard to me - if I don't want the responsibility of my choices, then it's not murder. But if I want the baby, then it IS murder!
The woman who has an abortion has enough emotional turmoil to deal with, and while they are guilty, I wouldn't want to add to that burden.
The REAL culpability goes to the doctors and abortion clinics who promote their wares without giving the full story to these poor women who are victims of society's teachings!

Murder is the UNLAWFUL killing of a PERSON with MALICE aforethought. Abortion isn't unlawful, embryos can't be proven to be persons, and women who abort don't have malice toward embryos. Therefore, it's not murder, no matter what you think of it morally. My own POV is that before the development of the cerebral cortex in the second trimester, there is no person yet, but opinions will vary.

There are groups out there working hard to change our Constitution and make these actions punishable as murder. Part of that strategy has been to make it possible to charge someone who kills a pregnant woman with a double homicide. Don't be fooled, this a back door approach to be able to build a legal case to outlaw abortion as murder.

Doctors aren't charged because we have stupid people in our country who thinks it is ok for this to happen, which it isn't. Everyone of us has a purpose in God's eyes, and as humans, we have no right to take a baby's purpose of having a life.

We don't charge the warden after an execution either but its still killing someone.Just because the law allows this killing to occur doesn't make it right. I'm an atheist myself so I'm not on the right wing band wagon on this but to me its murdering something that would become an infant if not for the actions of the doctors and seems to me to be wrong. There are plenty of ways not to fertilize these cells so killing them off because you were either horny or stupid seems cruel. and Please don't give me the its a woman's choice crap cause it doesn't fly.

It is not murder.
It IS a legally, constitutionally-sanctioned medical procedure to correct a condition the patient finds undesireable.
It is neither more, nor less.
It is a decision ONLY! the patient has any right to make. The people who feel it's their business may -when and if they become pregnant- make their own decision at that time.
Until such time, anyone NOT the patient should butt out!

Since abortion is murder, Doctors should be charged with murder. The mother also. And mostly the judges who allowed for abortion legally. The law that allows abortion is unconstitutional.
We are one Nation, Under God, with liberty & justice for all. This includes the baby in mothers tummy. If only the mother & the court system has the say in it, then this isn't justice for the baby. Liberty isn't liberty if it takes away the right to live from the littlest 'who'. Where is the justice in that.
The whole problem with people is that they don't think the littlest 'who' is a 'who' at all.
