I'm writing a paper about the bans on "sagging." I'm worried that a guy out on parole, who has given up drugs and committing real crimes, could go back to jail if he is convicted of sagging. Is that possible?

Parole is revoked and the person is sentenced accordingly. It certainly is possible.

Applicable laws ignore common sense. While most people would question the charge and conviction, the law itself does not. This case would set a bad precedent if the conviction stuck.

Parole is a gift and comes with restrictions. Should he get arrested for anything, he would be in violation of his parole and go back to jail. Many paroles even restrict a person from drinking alcohol. You don't have to commit a crime while drinking, just get caught drinking. A parole is a contract and you can't violate it.

If a person commits a crime while on parole, the person goes back to prison to finish up their original sentence, because he violated his parole stipulations.

The person may also be convicted of the new crime and receive a new sentence either concurrent or consecutively with their original sentence.

The law is the law.. doesn't matter how severe the crime he commits. Even something small could send him back to jail if he is on parole.

There are "conditions of parole" that are set when parole is granted.

I don't think that any misdemeanor would get a person's parole revoked.

However, what I could see is if the guy hadn't stopped using and he was arrested for "sagging" then he could be searched and evidence of further drug use is found then he would be in trouble.

what is sagging????? parole is the name of a boat right? and drugs is the dog on the boat? real crimes is like no life jacket?....omg.....jail for sagging a boat.

I believe parole is revoked. The balance for that crime would have to be served.

Why are you worried? He is scum. He stopped committing real crimes, so that means he is still doing little crimes. Lock his *** up.
