after spying on him in the fitting room, subsequently he was approached. this lead to him being jailed and charged with retail theft. I not aqauint with Penselvania but I am pretty sure that It cant be legal for store security assistance to spy on anybody in a fitting room so I told him I " dont think the means by which the evidence for probably cause was collected is legal so he needs to tell his lawyer and maybe he can put in some motions and have the case dismiss....... please we all know stealing is wrong but our right to privacy is most sacred. I mean under-what regime if any would anyone feel comfortable being whatch while changing! definitely not for no shoplifting deterrance... please help me with this on

The means by which they were observing him was not very specific. It could be that he was seen going into the changing room with three items (clothing or otherwise, you didn't specify) and seen coming out with only one. That is probable cause enough to stop the person and talk to him.

Also, remember that store security are still private citizens, not sworn officers. They do not have all of the governmental restrictions that peace officers do. All they need is suspicion to check the changing room and see if the questioned items were left in there and then if not, to call the police.

You are being watched by cameras or store personnel when you enter and leave a dressingroom. They note the amount of items you take in and how many you bring back out. Your friend is a common thief and deserves to be jailed. All customers pay higher rates to compensate for the money lost to shoplifters.

I care about privacy in my own home and i would sue the store for spying on the dressing rooms there are many people that have used the store and they have probably spied on most to all of them.take them to court.

sorry to break it to you but a fitting room is no longer private. cameras are every where because people have taken so many things while in them. stuff is stuffed into shopping bags down pants and into purses. sucks dont steal he is going to jail they wouldnt have followed him into a dressing room unless they saw him do something before that sorry. pick better friends he cant sue
