If the lady pulled into the traffic stream and hit your husband, she's at fault.
But the ticket your husband got "improper passing" means that there is more to the story, ie, she was already into the street, and your husband tried to dodge around her, etc. He's not telling you the full story, as a "speeding and causing an accident" ticket does not equal "improper passing" ticket.

The logical anwser would be yes, the lady deserves the ticket - not your husband. But the way they see it, as your husband 'shoud've' seen it coming, therefore he should've been able to avoid the incident, It is totally unfair how the justice system works. The lady should've owned up to her mistake, and her insurance shoud've covered the damage.

You were not at the scene of the accident, you didn't see what happened. You did not deny that you husband was speeding. Were there impartial witnesses present? You heard one side of the story from your husband, what about the lady's side of the story.

You would think so. Just who called the police first? The police will usually believe the person who called first. Fight it in court. Lots of pictures of the entire area leading to and of the accident scene. If you feel that strongly about it, talk to an attorney(a necessary evil,lol). Good luck

sounds like your husband if he wasnt speeding and was a safe distance away to back out then your husband is at fault. you werent there the police look at damage and talk to those who saw it. your husband probably sped up to keep her from getting out. hes at fault

Nope. Your husband should have been paying attention and yielded to the lady who was backing out. If they say he was speeding he probably was, you'll be suprised what you can figure out from the damage and evidence at the scene.
