I don't think you can sue them by the reason God designed the appendix not to do anything. It is not supposed to work for the body's benefit but to work when he wants to punish the atheist like you and me. Appendectomy is your only defense.
But the religious fanatics would say that God already creates doctors to take care of that. We just can't win you know.

No, because God has a plan for you and if that plan is the rupture of the Appendix, so be it.

the appendix is part of the lymphatic system, when I was in OR school, I was told that 100% of the people that lose them as kids develop colon (large colon) cancer
sure sue way and look like an idiot. I hear that God was run out of town on a rail. tarred and feathered claimed one
how do you suppose you will collect.

*is highly amused* I love all the people going, "YEAH, WELL, ask an Evolutionist why it doesn't work!" We have appendices because our diets a long time ago required one. As our dietry needs changed, the appendix became redundant. Now it's just kinda... there. It devolved, basically.
