As the legal guardian of the child, it is assumed your responsibility you make sure your child is in good hands. But once you leave them in care of a child care center or school, they now have the responsibility to make sure your child is not harmed and that he/she is taken care of. So, of course you would have the right to press charges, if you decide to take matters into your own hands. What the school admin should have done was make sure that the child was indeed going to be picked up by a family member or friend. If they did not see anyone of that content, they should have either asked for ID if a person was there, or make sure that someone is in fact there. I would check out your options and make sure you have the right tools to press charges. I would kick some major butt if anyone did that to my kid.

C'mon. What would that accomplish?
A big mistake, but pressing charges??
How old is the child?? Is this really a school or is it a daycare or is it a preschool???
If they are preschool age, then I would sit down with the director and demand an internal investigation. Depending on how that meeting went, then - at the most - contact the state licensing/accreditation board. But you will have to be willing to pull your child out.
If it is Elementary age, then, again, I would meet with Administration, demand an internal investigation, and if you are unhappy with the results then contact the Board of Ed.
But your goal should be to make sure it doesn't happen again and that your child is safe, not to exact revenge or punishment on some overworked school employee that made a mistake. There are ways other than pressing charges that aren't even likely to stick anyway and that in the end, will do you more damage then good.
Solve you own problem. The police have enough real issues to deal with.

Well, first of all, I would find out where the office lady got the idea that the grandma picked him up! How old is your child? Did your child tell this to her or someone? That is very odd, you need mroe information before thinking about pressing charges. Something is fishy! Your husband went to the school and did not see your son, but he was outside?

First off, how old is your child? I would be very upset if this happened to me.. My daughter is in third grade, and her teacher walks out with her class and makes sure all of her students are picked up, or walking on there way home.. Most schools here make you sign out your child if they are in pre-school or kindergarten. That's how it's always been here.. But, there are a lot of schools that just let the children out and they go on doing there own thing thinking that the parents should be there to get your child.. So was your husband late to pick him up? Cause if so, that just might fall back on you and you won't be able to do anything about it... Find out what their policy is, you should have received a handbook the first day of school, and go from there.. If your husband wasn't late, then yes, I would be very upset and talk to someone about this and see what you can do...

This exact thing happened to me when I was in kindergarten. My older sister was supposed to walk me home, but had to stay afterschool, and my teacher left me alone outside the school. I was abducted and held captive and beaten for 3 hours by one of the students from the nearby high school. My mother filed a complaint with the school board (and obviously with the police), and when that got us nowhere she took her story to the newspaper. A lawyer contacted us and offered to take our case pro bono. Long story short (too late) the school settled out of court and agreed to pay my tuition at a local private school (on the grounds that they didn't provide adequately for my well being.)
Since alls well that ended well with your situation, I wouldn't take things as far as a lawsuit. I only gave my story to illustrate the sort of things that could happen. I would file a complaint with the administration against that teacher, and make sure that your approved pick up list is explicit, and that you include instructions that anyone picking up your child has to show identification. This teacher really dropped the ball here, and deserves a written violation in her file.

You can make a report on the teacher and the school. They are suppose to provide proof of who picks up your child and what time and since the child wasn't even taken anywhere that will need reported. Go to the school board.

i will look into it. All schools should have a list of who to or not to pick up. Plus someone should always be there to watch your child until someone does come. That was irresponsible for them to do that. I would call the school talk the principle about that and the cops.

I personally would go into the principal's office and find out what happened and remind them of the seriousness of this matter.I would also request that my child be put in a different class, if no class available, then change schools.

well it could have been a mistake, but yes, if you really feel you want/have to then you can press charges. the school is responsible for the child until someone arrives to pick them up or until they get home.
