Is there a specific ticket they have to give you? Do they let you move on?

I'm writing a situation in a book I've been working on where this happens, and I'm pretty sure they don't just let you go with a warning. Am I right?

What is the procedure for this, generally?

Depending on whether or not it's a broken lens or the bulb is broken.

If the red lens is broken and the bulb still works, then it would be a ticket for a white light emitting from the rear.

If the whole thing is broke, it would be for no brake light (in Ohio you need two visible brake lights) taillights you only need one, so if only one is broken there wouldn't be a ticket.

I one time got pulled over for a broken side marker light and a tail light out at the same time. I was given a warning and told I had like 10 days to fix it. If I got pulled over after that ten days and it wasn't fixed I would have gotten a ticket and had to pay a fine.

The so called "Plain Sight Doctrine" can give police the right to search your vehicle if there is in plain sight in the vehicle something that is illegal. That means the officer cant move anything or open anything to determine whether the thing is illegal or not. See Harris v. NY The plain smell doctrine can serve the same function. If there is an odor of marijuana in a vehicle, or of alcohol on a drivers breath, this gives cause for a search not only of the vehicle but of the person of the driver and probably any and all passengers as well.. Other than those two instances, separat4e probable cause is required for any further search of the vehicle. It should be noted that the driver and/or the registered owner has standing to refuse to consent to a warrantless search of the vehicle. See Rakas v. Ill. But, there are exceptions which allow for inventory searches in the case of a lawful arrest and/or an impounded vehicle. See Opperman v. SD

Usually they tell you to have it fixed and let you go. Most cops say they stop cars for a broken tail light because it can lead to more serious things found. It is also a way to stop someone if they feel suspicious about something.

They pull you over and give you a ticket for a broken tail light lens.

Usually you get what's called a "Fix-it ticket" ...which means u have so much time to fix it and present info to the court that it is indeed fixed. U may even have to bring the vehicle in for inspection. It does depend on the City you live in. If u r writing a book, contact your local police department's public information officer and she/he can arrange an interview for you with the appropriate person to discuss all of your questions.

The ticket would use the same form as a speeding ticket. In most states, you would receive the citation and be allowed to go. If you get the light fixed within a specified period of time, some states will waive the fine.
