Shouting match turned into, a pointing match, resulted in male punching. Police were called by female,neighbor claimed female hit him 1st *untrue*,police said they were unable to do anything b/c they didnt witness the assault.
Female went to hospital on following morning,where initially it was thought to be a broken jaw., but resulted in facial contusion and cevical strain. Ivs of dilaudid,saline and nausea were administered. Hospital strongly urged going to police station to file warrant-that was done - what are the guidelines of what is to do next and what can be expected?
A witness was present and filed a report as well.

That being said, go to the police with your hospital report and your witness.

Wow, where were the Police when you were in the hospital? They should have been summoned by the staff & photos should have been taken of your injuries. That's how it works in my state, but I suppose things are different in NC. It sounds like it was mishandled. One thing is for certain...you need to get yourself a restraining order on this "man", in case he comes after you for retalliation. IF he has already lied, then he'll be planning his next move against you just to get even & teach you a lesson. This type of a man seems to think that all women need to be "taught a lesson" & he'll get stupid & then you can have him put in jail for a few years. Having a witness is a good thing. If this man has a violent past, then both of you should receive assistence from the witness protection program & victims of violent crimes units. Even without a past, there should be a fund in place to assist a victim of a violent crime & you definately fit into that category if he caused you an injury of any kind.

You need to talk to the police and file a complaint, unless you threw the first punch then it doesnt make any differrence if your'e male or female, the one who strikes first is the guilty one. And when you go to the police?? try to appear sober. lol, see what drinking does? LOL, you werent drinking huh?
tell me another one. If you were sober you would've known when and how to walk away from it.

File a criminal case of serious physical injuries under the Penal law against your neighbor.

The detectives will be by to talk to you next, then after their investigation it will be given to the district attorney and he/she will decide if the case is strong enough to go to court.

where i live if this was the case the plice would take both of them to jail.she say she wants to press charges and the guy would say thhe same thing and the cops would take both to jail
