my brother-in-law involved in a car accident which he hit a utility pole and parked cars at a gas station in Va state. the police gave him a ticket for failure to control a vehicle and he has a court date coming in three weeks. Does he goning to lose his driving license? dose he has to have a lawer?

there is no DUI or DWI he just got his license.

and he doesn't have any points on his record. by the way he was driving a rented car.

You failed to mention why he caused all that damage. Normally, failure to control a motor vehicle, refers to a minor accident. It might be advisable that he at least consults with an attorney at this point. There's always the possibility that he could lose his license depending on the circumstances. FTC is only a bad charge when there is a DUI or a DWI on top of it, if the police did not take him to jail at the scene, then court will be just a means to an end.

They may have a DA there that will talk to him, at that point he can try to plea down the charges, IE: Get them to change it to a non moving violation or to a lesser moving violation. He also may want to ask them if he goes to driving school if they will dump the ticket all together.

If he doesn't have a history of bad driving, he really has nothing to fear over loosing his D/L. If he has have a few infractions, they very well could suspend it, as they would for a speeding ticket.

From the sound of the accident, he could have been charged with a lot more, so a little FTC is not a lot, here in Colorado if a highway patrolman sees you drift over into another lane of traffic you can get a FTC, to put things in prospective for you.

To hire an attorney for this is an over kill. It is not a hard charge to answer to, BUT if he has added charges, he may want to think about the attorney.

VA IS A COMMON LAW STATE AND HAS SOME REALLY DIFFERENT APPLICATIONS OF THE LAW--IF HE HAD INSURANCE AND COVERAGE ON VEHICLE-INSURANCE COMPANIES WILL SOLVE THE LITIGATION PROCESS OF WHO PAYS WHAT-WHY DID HE LOSE CONTROL OF CAR AND HIT A POLE, AND CARS?? QUESTION TO BE ASKED BY THE COURTS--A GOOD INSURANCE COMPANY WILL STAND BY A CLIENT IN COURT THOUGH MOST DO NOT A FAILURE TO CONTROL A VEHICLE IS NOT ENOUGH TO LOSE A LICENCE BUT THE QUESTION IS ABOUT HIS ABILITY TO BE COVERED BY THE SAME INSURANCE COMPANY OR ANOTHER AND THE RATE WILL DEFINATELY GO UP UNLESS THERE IS A GOOD REASON WHY HE LOST CONTROL OF THE VEHICLE--WAS THIS A VEHICLE DEFECT OR DRIVER DEFECT-APPARENTLY HE WAS SOBER OR THEY WOULD HAVE BOOKED HIM FOR DUI??

No, he wont lose his license for a traffic ticket.

Getting a lawyer to represent him is totally up to him. A lawyer maybe able to help in getting the fine reduced or having no points on his record, but in the end if he did commit the offense he will be found in violation with our without a lawyer.

he should learn how to drive better for sure and yes it would be best if he had one and if they didnt take them when it happen more than like its just a fine he will get which he could have payed already not had to go to court and pay the court cost also
