Hi, im in a horrible situation with my daughters dad (you can see what on my previous question), I am a canadian citizen, and i think its time i moved back to Canada with my children, the only problem is i dont know where to start, my dad is going over soon and i have family over there, but as i am seperated from my childrens father i am on welfare, when i move over to Canada and am settled and girls are in school, (they are 2 and 5), then i will get a job, my boyfriend is English will he be able to move with me to live he has a gd job in computering (even though he gets paid less than he should for what hes doing) what are his chances, and what are my options, im not coming to Canada to sponge the welfare i am not like that just want a better life for my children thankyou for your advise in advance.

This is indeed a difficult situation for you.
First, if either or both of your children were born outside of Canada, have you registered their births with the local Canadian Embassy so that they have proof of their Canadian Citizenship? If not, you need to do this asap. This will make the process of bringing them into Canada with you easier.

Second, especially if the children were born where you are living now, there may be a court ruling that prevents you from moving out of the country. Check with your solicitor on this.

Third, your English boyfriend will not be able to just pick up and move with you. He will have to go through the process to get a temporary work visa, or a permanent residency visa, which can take several years. While there are special rules for married couples, and Canada recognizes commonlaw relationships, your situation is complicated enough that I would strongly recommend seeking the advice of an experienced immigration lawyer in this regard.

Once you get through those hurdles and still decide to move back to Canada, then you would want to arrange to stay with family in Canada while you get on your feet, and the rest will come from there.

You are in a real catch 22 here. You can't take the children out of the country without their father's permission. So that is your first hurdle. You say your barrister isn't doing much on your behalf - then get another lawyer!
As for coming to Canada and having your boyfriend follow you here, that has nothing to do with the question. He isn't the children's father so he doesn't enter into it at all.
Check with the Canadian Consulate in Britain to find out what steps you would have to take to return to Canada. Get an affadavit from your family that they will support you and provide you with a place to stay. And that they will pay the airfare home for you and the girls, if you are allowed to take them out of the country. If their father will not surrender custody, there isn't much you can legally do. If you elope with them, or abscond with them, that counts as abduction and you can really wind up in hot water.

I don't mean to be impolite, but how are you going to be able to afford the airfare back to Canada? You can't take the children out of the country unless you have their father's written permission. And your boyfriend would have to apply to work in Canada, and that's a long process.

you kids are not canadian. you may have to apply for citizenship for them go to www.cic.gc.ca the official immigration site asrt from there.

I pay over %80 all money I make here to rent gas and TAX....nothings left ....welcome to most expensive place ...Canada
