THEY DON'T LIVE WITH ME FOR THE FULL 6 MONTHS , HOWEVER THEIR MOTHER DOESN'T FILE TAXES AND RECEIVES SOCIAL SERVICE STIPEND. I PAY CHILD SUPPORT, SHOULDN'T I RECEIVE DEDUCTION AS WELL ???

Have the mother sign Form 8332 waiving the exemption and child tax credit to you. Then even though the children do not live with you, given your information you are allowed to claim your children on your tax return and receive the $3,400 exemption per child and the Child Tax Credit of up to $1,000 per child.

The amount of support you provide does not result in the exemption. What is required is that both parents provide over six month's housing for the child plus pay over half of their support. This appears to be the case for your family.

If you provide over half the childrens' support and their mother signs a release, you can claim them. Just because you are paying child support doesn't mean you have paid half their support.

If the custodial parent signs form 8332 giving you permission to claim the children, you can. Otherwise no you can't claim them, even if you pay support.
