What if the Victim or the girl in this case was the first one to start hitting the Abuser. And then the Abuser was the one that threw one punch unfortunately he left her a black eye. No arrests were made. But the cop said that the girl should have gone to jail because she threw the first punch. But instead he made her the victim. She requested no charges be made since it was an accident. She also told the officer she threw the first punch. There was an altercation that got the Abuser riled up. It involed 4 guys trying to fight him. She was not the person that called the cops. And the person that did call called the police department. Anyways she doesnt want charges filed. And again she was the one hitting him. Does this sound like a case the DA will pursue. Im not asking for me im asking for my bro. She was at work when it happend. And her co workers were trying to fight him. four against one she was holding him back and well he accused her of not having his back and she hit him a lot,

They took Pictures of the incedent but again no one was arrested there was no witnesses. His sister was there but she said that she only saw her hit him and he wasnt there when he hit her.. i Know its sad story......they both need hep........again I thank you for your insight you guys are always spot on...smart people on these forums........Thank You its very Helpful.

Unless things are awfully slow and they are just hanging around the office twittling their thumbs, the DA's office wouldn't touch such minor stuff.

In domestic violence (DV) incidents, it's not about who threw the first punch, but who was the dominant aggressor in the altercation. Most states have DV laws that do not require the victim to want to prosecute. This was put in place because of the dominant control most abusers put on their victims, making them too afraid to press charges.

Depending on their relationship and how the laws are written in your state, the DA may not have any choice but to prosecute. Unfortunately, you were not there to be able to provide us with a detailed account of what happened. That makes it difficult for anybody answering your question to guide you correctly.

This is too confusing...is the abuser your brother, or is the abuser his friend? Anyway, do you know why people don't go around socking people every time they get angry? It's because they are mature and can control their urge to do bodily damage. I say, the DA should pursue it, when he runs out of important things to do, and toss them all in the clink. I don't like violence...they need a cool-down in the cooler!

If the responding Officer didn't arrest him I don't think the writing DA will push it

If nobody was arrested, then the prosecutor will probably never even know it happened.
