My brother (18) got a 16 ( soon 2 be 17) year old girl pregnant. She found out in January. She is due in 11 days. Her father was preacher and was shameful so he moved from KY to Oregon which is 2500 miles away from the father and his family. My brother wants custody of this child, or to atleast see it. She has threatened adoption and other stuff if he does not move to Oregon. He had a plane ticket to move out there today.. but canceled it. He should not have to sacrifice his life down here to go and abide by her family's rules, he would be staying 50 miles away from her and the baby with her grandmother. Can anyone give me any advice as to how to go about getting custody.. and his rights as a father?

Well, a lot of the problem is that he is guilty of statutory rape and if Preacher wanted to press charges, he could.

In any case. he MUST talk to a lawyer, as we have no full idea as to what he could do.

He needs a lawyer, NOW. She can't put the baby up for adoption without his consent, so if she's threatening to do that, she's just pulling his guilt chain.

The age of consent in Kentucky is 16, so there's no problem about him being charged with statutory rape. However, in Oregon, the age of conset is 18 -- so moving to Oregon may not be the best move for him right this second.

He MUST get a lawyer.

As far as "sacrificing his life" -- too late. If she chooses to keep the baby, she is basically sacrificing HER life -- why should she be the only one? He was the "adult", at 18, screwing a 16 year old. Actions have consequences -- and this one is a doozey. Regardless of whether or not he gets custody, partial custody, whatever, his life is already forever changed. He got her pregnant -- now he's got to figure out how to make the best out of a bad situation.

Well he needs to get a Lawyer right now! There are free lawyers for those of low income. Call the Department of Human Services and ask if they can give you the number or guidance on how to find the number. Meet with a lawyer right away. He has rights! She can not adopt the baby without his concent, if he gets a lawyer he can stop this. There are also limitations on the distance shes moved. I believe that makes HER resposible to get the baby to him for visitation. Now GO hurry, get a lawyer before it gets any worse!

he needs to seek professional help. lawyer. and fight to see his child but if does not have the means to see the child on the regular at least and see the child every few months. the is the price you pay when you are not married and are doing grown folks stuff. having sex. there is really nothing he can do because the parents can bring him up on statutory rape. sex with a minor. just keep the faith and do what you can when you can. but dont allow her family to dictate to you about you moving up there and adopting your child out. stay posted to her so you will know whats going on. if she tries to put the baby up for adoption, then all he has to do is sue for custody on the grounds that she doesnt want the baby...either way they are going to need his signature to go through with the adoption anyway

I know she can't put the baby up for adoption without his signature. I suggest he get a lawyer.
