won a dispute out of small claims court about a month ago,for posesssion of a vehicle, and money that I paid to a mechanic to fix my car...anyhow the ruling disposition asked that the defendant would pay me 1200.00 plus he was ordered by the court to deliver my car, (in which he never did) on 8/15, so he goes and put my car up for lien sale because I owe him storage costs from the 8/15, so I try and go and talk to the defandant to try and pay the storage costs, and he tellls me that he's going to sell the car, and tells me that he will not accept my money for the storage costs, so I go over there with the police, they tell him to give me my car otherwise he would be in violation of a court order, however he has 10 cars which are all salvaged cars blocking my car, and tells me he can't move them, so the police advise me that they cannot make him move his cars and tell me to go back to court, so now I have a notice to go back to court on appeal of the original judgement

I'm alittle nervous because he's saying I owe him for storage costs from 9/2005, however the car wasn;t actually signed over to me until 6/2007 plus I do have title to the car, showing that he signed the car over to me on the pink slip that he sold the car to me for 750.00 but now he's came up with some phoney receipt that the car was 3500.00 and that I should have paid that as well so I owe him that what will the judge go by in a trial de novo?

You have the basis for a criminal fraud charge against this jerk. Go talk to your County Prosecutor, States' Attorney whoever has the authority to bring charges. And, check for an injunction against him should he choose to go further in his ignoring the Court Order.

First file a complaint with the PD for Theft by Conversion or whatever the law is in your state.

The prosecutor will tell you if you have a case or not. In the mean time got to the Clerk Of Courts in your county (or go on line) and see what the thief's history is. He handles himself like he has done this before.

Check the Sheriff's arrest records also. BTW, the sheriff actually has the authority to enforce a Court Order no matter what obstructions are in the way of regaining possession of your vehicle. Evictions are Court Orders, impounding vehicles are Court Orders and if they tell you to go back to court go to the High Sheriff and voice your complaint. (He is an elected official and may not want the bad publicity.)

Turn his tactic of throwing up roadblocks to you covering him up with legal paper work (the free kind0. You may have to pay some filing fees but you can recover them in the following law suit.

File the complaint with the Attorney General. Go to court and tell them that he doesn't care about their orders. Hopwfully, they will get him arrested. I don't see why you tried to talk to the defendant. He had the court order against him; all you had to do is to sit back and wait, then call the police, and take him back to court./ . He walks all over you with his BS.

I have no idea why the cops didn't order him to move the cars and had him arrested for violating the court order. Looks like they are walking all over you as well. You need to toughen up.


I agree with the first answer. File the police report and REPORT THE CAR AS STOLEN (he DID steal that car!). The cops will arrest him and return the car to you. Then, go to that court, and tell them he violated their orders. This will bring more charges against him. Report the car stolen right now.

The police SHOULD have ordered him to move the cars. The judge WILL order him to do so and should fine him for having the car blocked. Any lien he has filed will be voided by the court. If I were the judge (I am not a judge), I would cancel EVERY lien he had filed on any vehicle and order that not be allowed to file liens for a period of time.

I would go back to the court, and ask how you can get the order enforced, and raise this stuff about storage costs .
