I want to do a purse with special things on it, and no one has it anywhere (and sorry don't want to give it out for fear of copycat) and was wondering do I HAVE to HAVE a patent, and license. It would be a purse for making life easiter and convenient. No special names, or trademarks or logos necessary.

I mean I don't have $7,000 to spend on a patent, and attorney and other etc......

Tell me do I still need one?

Yes, I would be making a lot of them for stores, and selling them.

Well, if you don't patent it then anyone else can legally make it, and someone else who makes it could then patent it, and if you wanted to make it you'd have to pay them for the right to make it, even though you were the one who invented it. Patents protect your right to being the one who invented it, and the one who can sell it or can license others to sell it if they pay you for the right to make/sell it.

Copyright a sketch for now. That's about $45 at the Library of Congress. Then get a Provisional Patent at the US Patent & Trademark Office using the sketch you copyrighted. That's about $100. The Provisional Patent is easy to file. It's self explanatory. It gives you a whole year to file the patent.

Hopefully by then you will have raised enough money or have enough orders to file the patent. Once you file the patent - you can start licensing the product to major designers/distributors like LVMH etc. File something to make them pay to license - if you don't they will just do it without paying you.

That depends how badly you want to keep this to yourself. If you badly don't want your idea being copied by others, then you should get a patent. However, I believe there are cheaper ways to get a patent. You'll need to do a little bit of search on it because every state is different. It all comes down to how badly you want to keep the design to yourself. I know that purse is very hard to get patent for it. Make sure you find out the correct information. You can probably find some government offices on yellow pages that can answer your question. Get more then one opinion; don’t settle for one person's/place’s idea.

its a protection for you and your creation, if that's what you want. i believe you can file a patent with the patent office yourself

there are also various searches that need to be done as well. you could do it yourself, but it probably be better to use an attorney.

You don't need a patent.If you are successful than others will copy. You can revisit the idea of a patent if you become successful.

There's no legal requirement to have a patent, but if you don't, anyone who sees your design and likes it can copy it and sell it also and you can't stop them.

i think that parents ar emade to protect the logos and the invention of someone so if you make the purse for yourself and do not sell it for money i do not think that you are doing anything against the law
