You sue, if they're not cooperating, or contact their insurer, if they are.

If my understanding is correct, your uninsured car was totaled by a driver using a learner's permit. This driver carries insurance. That insurance includes liability for damage to other vehicles.

If I understand you correctly, the insurance company of the driver who hit you will repair or total your car, meaning they'll give you a check for its actual cash value.
The fact you have no insurance, while stupid and irresponsible, is irrelevant to this accident.

was car parked on public street? If so, you are sol. If on private prop. sue him and his insurance co.
