im doing my immigration paperwork and they ask me a copy of my husband taxes including W-2s but he doesnt have them.
is it because he has his own bussines??
i have to write a statement describing why he wasnt required to file one; what should I say??

he filled his taxes every year! he's totally legal.
i just dont know why he doesnt have a W-2 or if he doesnt need one.
and yes, his bussines made more that $400 dolars since the day he started it 6 years ago.

he filled his taxes with an accontant. he has form 1040, schedule C, SE and a form 4562.

You get a W-2 from your employer if you are an employee, so yes, if your husband owns his own business, then that's why he wouldn't have one. But if his business made more than $400 last year, he was required to file a tax return - if he didn't, he illegally evaded taxes and this is going to be a problem.

OK, with your additional info, just take in copies of his tax returns. If they still want a statement on why he doesn't have a W-2, just write "My husband is self-employed so he doesn't get a W-2. I am enclosing a copy of his tax return."

In your case you do not need a W-2. Present immigration with a copy of the tax return which was done. It will show the proof of income, which is what is required.

Your husband has his own business and never had a job so he will not have any W2.
He has filed the required returns. Take the copies of the returns.

He still has to file tax returns. Copies of them will suffice.
