We have never even spoken to each other but they do things that aggravate my family. They are loud and disrespectful not to mention their kids get into our mail box. Can you put a restraining order on a neighbor just because you don't like them or does there have to be some sort of threat involved?

When you file a restraining order, you have to go to court and tell the judge why you are requesting the order. "We don't like each other" would not be acceptable to most, if not all judges.

However, if their children are tampering with your mail, you can call the US Postal Inspector and report them. Mail tampering is a Federal Crime.

I dont think so, I believe that there has to be a threat. You might have something with the Mail thought. That is a federal offence to get into someone elses mail box. Check with the police.

the answers above are good- my neighbor put restraining order on neighbor & it was funny cause order said 50ft & that was pretty much to the property line. no incident involved like in your case, just alot of little annoyances

Why don't you try actually speaking to each other before resorting to legal action? Wouldn't you feel sort of silly saying "I need a restraining order because that person I've never talked to annoys me"?

I don't think there is much you can do about them being rude neighbors. BUT, messing with someones mail is a FEDERAL offense. Call your post master and file a report.

Talk to the Post Office. It is a Federal offense to tamper with someone's mail. You can always have the Post Office go talk to them, not you. Ask the postal employee to please act as if he saw the kids in your mailbox. Otherwise, the whole dislike will just escalate.

No. They have to pose a threat to you or your family. Annoying doesn't cover it.
