I know this couple that has their neice in their custody because, the childs mom is into drugs. The lady has had like 2 or 3 chances to do what the judge ordered her to do but, she had not do it. The couple goes to court somtime in September.to get full custody. If the mother gets a lawyer what are her chances of getting the child back? She is also pregnant with a second child while she is in jail.

If she is not doing her treatment plan the chances are pretty slim. They are usually slow to terminate rights but they won't give a child back to a parent that is not complying with the court ordered treatment plan. If she is in jail or tests positive for drugs when the baby is born it will be taken away at birth.

It does depend on the state. In Florida the mother has 18 to 24 months to follow a court ordered plan to regain custody or the child is put up for adoption. Considering she is currently in jail realistically speaking she would not be able to start her plan until released. The plan usually includes a job, parenting classes, clinical evaluations, and a home study. If the parent makes reasonable attempts to complete the plan the judge will usually give some concessions to parent wanting to regain custody. It sounds like the mother will probably lose her parental rights.

Very slim. The court decides based on what will be more favorable for the subject child. Since the mother has had previous drug history and has also a bad conduct with the court, she will not be granted custody of the child. She may however be able to get supervised visitation once to twice a month. Even if she gets a lawyer, it will not do her any good. It won't matter if she is the biological parent.

pretty much the only chance the mother has is to admit herself into a rehab centre to get clean and stay clean for at least 6 months before even trying to gain custody. the judge will probably grant the couple short term custody pending a drug test on a set date

Some times the mother can get the kids back if she in jail and doing time she be doing a drug rehab so the judge might might sometimes give her a third chance, I hope for the childs sake she doesnt get her back!!!

Depends on the judge the county usually keeps trying for reunification unless they feel that its too dangerous. The county will probably take the child she is carrying when she gives birth at the hospital.
