I live in an extremely rural area, and I followed a policeman with someone in the car today. I was wondering, if they arrest them falsely, we have no public transportation, and they have no money and no one to call, do the police have to take them home?

If not arrest, just taken in for questioning. Do they have to take them home? I mean on TV they always just leave.

Well, they really don't "have" to do anything, except abide by the law and their department's rules and regulations. However, if it was truly a "false arrest", then they surely could, and probably would, do it as a nicety, if for no other reason that to save a little face.

If it was just for questioning, then it might largely depend on the actions of the person. If he/she were a totally smartass, uncooperative, asshole, then they probably would not. On the other hand, if he/she were completely cooperative, helpful, and nice. Than they might very well do that.

Either way, i don't think that it is in the lawbooks anywhere; if anything, it would be a departmental policy, perhaps mixed with the generosity/kindness of the officer involved.

They don't have to take anyone home. Sometimes we give subjects rides home after they make bail if for some reason no one can pick them up, and it would be hazardous for them to walk. Also , juveniles are usually turned over to a parent, who is usually served paperwork re the juveniles arrest.
Also, sometime people who aren't arrested get rides, like broken down motorists, etc. Finally, many departments have ride along programs where someone is allowed to ride with an officer and observe. It might even be a detective going someplace with the uniformed officer.

The only thing they would have to do would be to release you from custody. If you live in a rural area, don't know know police officer? I grew up in a small rural town and the local deputy has known me since I was born.

I would submit that if you were faced with that, the police would help you get home......you would be more trouble to them sleeping in front of the office. :)

They won't take him home. Unless the County runs a taxi service using off duty Police cars.
They will let him use the phone to call for a ride, though.

I doubt that any department has a policy that requires arrested persons to be transported to their domicile. Departments are also very careful about "false arrest", that gets you sued.

The police can pretty well do anything they want. It's usually your word against theirs. Stop getting arrested and you won't have to worry about it......just kidding
