i bought a car from dealer, financed. this car salesman is a little shady. i got approved over the phone from the finance co. so i signed bill of sale and he transferred the car to me. 3 days later he calls me frantic saying that the bank didnt pay him for the car because paperwork was incorrect. so since i have the car and signed a contract can i still keep the car??

well i read that contract and there is no clause about if finance doesnt give him the money he can get the car back. i feel like its not my problem

well i see what most of you are saying. but i am doing what my contract said. i owe the finance co. for my car. i shouldnt of said the paper work wasnt right. it was right. only thing is, this jerk car salesman ripped me off. and finance co. wants him to get 6 references and some pay stubs ect. so i was approved to the finance co. just this dumb car salesman let me drive off the lot without getting everything he needed. this guy is so dumb because he lied to the finance co. and said i put $2000 down on the car when i didnt give him a penny. contracts show a down payment that i didnt make. so when this all clears i either get $2000 or a car. all works for me.

you have a contract that says you paid $2000.oo tell the dealer you want to return the car and you want your $2000.oo if he refuses keep car and go to court the judge will uphold the paperwork that says youpaid the money if dealer says you didnt its his word against yours and you have written prtoof signed by the dealer the judge will hold HIM accountable. about time someone got a dealer they are always getting us.

It is nothing but your problem. It was because of your credit that the bank declined the loan. Unless you can stroke a check for the full amount, you need to take the car back. If you choose to not take the car yourself, someone will come get it or they will report it stolen. Then your problems have just become much worse.
Go ahead, take the chance.

Correct me if I'm wrong, but a bill of sale would state something to the effect of "I, (your name), agree to pay (purchase price) for this car". So if your financing fell through, then obviously you haven't fulfilled this part of the agreement. The fact that there's a 3rd party financing the sale is beside the point. - YOU are the one legally responsible for paying for the car.

NO-it don't work that way.
There will be a clause in that contract that if they don't get the money fron the finace co, they can sue you for it if you a) don't give the car back or b) don't pay

Uh NO! It don't work like that. He's probably in trouble if not gettong canned but you either owe them some "correct" paperwork or a car.

If you decide not to pay I assure you they'll have it repo'ed or sue you. Then you'll owe for mileage, damage etc.

your going to have to either sign new pw with the correct info on it, or find a new lien holder to finance you. You dont get to keep the car, you didnt pay for it.

lol @ "its not my problem"....i guess grand theft auto is no big deal to you....no matter where the paperwork mistake is you DIDNT pay for the car, which is in your posession...sounds like a trip to jail and possibly worse if you choose to ignore this "small" non-problem.

sounds like its his problem- he can fix his paper work and have you sign whatever you should, until then its his problem
