my car has not been driven since june 2007 due to the fact it needed major work for an mot, and me being poor was saving up, car was hit by a hit and run driver (police got the person) now my car is a write off and i dont know if insurance will pay out for it because it doesnt have an mot! i have the failure certificate detailing what work was required and it was due to get its mot 4 days after the crash. do i stand a chance?

No problem, buddy, just tell your insurers and they will do the necessary to claim off the other person's insurers.
The MoT, actually, doesn't matter, all they require is that the vehicle is roadworthy if it is being used on the road. We all know, don't we, that the MoT is NO guarantee of roadworthiness, it even tells you that on the certificate. You could have a valid MoT pass today and something could go wrong on the way home to make it unroadworthy.
And, in fact, it wasn't being used at the time of the accident.

If you had comprehensive insurance then I would expect the insurance company to pay for the damage (but obviously not for the repairs) - subject to the excess of the policy - which you claim from the other insurers. Most insurance companies do not require the vehicle to have an MOT. There is a requirement that the vehicle is kept in a roadworthy condition - but if they rely on that you should point out that the clause is there to ensure that the vehicle is only being driven when safe to do so and it would be unfair on you to rely on this clause to avoid payment. (Use the word unfair)
If they do not then you have a perfectly good case to claim for the damage from the insurers of the the vehicle that caused the damage - assuming it was the owner who was driving and not joy-riders or whatever.

Even though your car was on a publoc road when it should not have been I think you insurance cokmpany may pay out, but if it does not you have a case against the other driver. He has no right whatsoever to damage your property no matter where it is (UK Law) If the insurance pay out they will make a cllaim against the other driver under the rights of subrogation you have given them in your policy. In other words they wil sue the other driver using your name as the Plaintiff

Read the fine print in your policy but you'll probably find that no MOT means no insurance. However if the police caught the person responsible then it is then guy that hit you that has to pay the price, hope he has insurance (although I doubt it if he drove off) if he has no insurance then it's down to the courts to award you compensation and also down to them to make sure its payed (good luck on that front) If you get in touch with your insurance company they will be able to give you more detail.

As you have said the other driver was insured. It is down to his insurance to deal with yours and he was arrested , so you have the police evidence. As for the lack of MOT, thats a poser, sounds like your in the lap of the insurance companies.

I think that you will find out that as you say the other persons insurance will pay as he hit your car, but they will only give you scrap value for your car as it had no MOT as you say therefore not road worthy. If i were you i would expect them to fight you all the way and if / when you do get anything it will be scrap value for your car probably 100 to 200 pounds!

Was it hit on a public road? If so was it taxed? If not am surprised the police didn't do you for that knwoing them! However insurance is insurance whatever and if you've paid your premiums they should pay out, although if your car was not roadworthy obviously you will get less than the full value.

it would probably take you the same time to call your ins. company and ask them that it does for you to wait here for more answers. it all depends on if and what policy you had on your car. the most help is your insurance company in situations like this!!
