I know that it is indeed safer for a child to ride in the back seat, but what is the legal age? I have a small Nissan car and if one of my kids has a friend go with us, my 5 year old has to sit in the front in her booster seat. They can't all sit in the back, there's no room for 2 boosters seats and a carseat.

I'm aware that one of the dangers is the airbag deploying and hurting her, so I move the front seat all the way back.

Am I breaking the law here? I'm in Texas if it matters.

No - you are not breaking the law. If a child is both under 5 *and* under 36" tall, then they must ride in a safety seat. Your child is over 5, and therefore may ride in the front.

Yes, you are breaking the law.

However, the law is based more on size than age. If your 5 year old is the size of an average 10-12 year old then you might be ok.

I forget the size limits but that also is based on height AND weight. A skinnny child is NOT allowed in the fron until they reach the minimum wieght.

Go to some of the web sites that sell child car seats. Tehy are fairly good at giving the required height and weight by law.
