Call the police and tell them what you know and what has happened so far. I assume you know what the stalker knows from phone calls or e-mails. Tell the police about them. Turn over any e-mail you may have. Show caller ID information. They will ask for anything that appears to be missing.

I don't think you need to prove it to the police. You need to prove it to a judge. At least here in KS, to get a protection from stalking order, you have to file a petition and have a hearing. The forms are provided. Then the defendant gets served with a copy. If the defendant wishes to challenge the order, they have a certain number of days to file an answer and request a full hearing. Again they provide forms for that. If the petitioner has evidence such as disinterested witnessess or video tape then the order would almost certainly stand. The defendant still has the opportunity to present a defense.

First of all you need to report it, have a unit come out or take the info by a department called teleserve...if they have such a thing at your local police department. Its always best that you request an officer to your place and have him take a report in person/// be sure that the officer gives you a case number, then from that case number every time this happens you make other reports... be sure to follow up with the investigator or division that handles this case.. not the local number you call for dispatching a unit or 911. Find out what department has your case number, and who is going to handle this case for you. Get a video of this happening... keep building your case, have witnesses and have them taping this going on... the more you report and have more information to add... keep building the case.... and have backup proof with video and tapes

You need to keep a log of information times dates etc. anytime you see him, he drives by, calls, etc...write it all down. Save any answering machine messages/voicemails. Anything that is suspicious make a report to the police. Try to build the case for the police in case something would happen. right now it doesn't sound like he is breaking any laws, but your community may have different laws and he might be. Just be very aware of your surroundings and be careful. Stalkers are messed up/obsessed people. You could also contact your local Victim Service Office and they may have tips for you for protection.

Is it possible this person has installed some kind of surveillance equipment on/near your home or on/in your vehicle? You might hire a local security company--one of the "nanny cam" businesses--to see if they can spot any such. They might even offer free advice about where to look for yourself. If you find that kind of evidence, I'd say the police would have to listen. (I saw something on Dateline or one of those shows about an "ex" who had installed a GPS device on the bottom of his former wife's car, as well as a voice activated listening device.)
Failing that, keep your phone cam handy. Perhaps you can snap pix of the jerk when he cruises your house or place of business. Enough of those time-stamped images might also be compelling to law enforcement.

1. Document everything;
2. Get an answering machine which has a mini cassette and save all messages this person leaves;
3. Save any e-mails you may receive and print them out;
4. If you are receiving hangup phone calls, call your local law enforcement and ask them to put a trace on your phone line;
5. Carry a camera with you everywhere and take a picture of this person every time you see them or their vehicle then write up an explanation for each occurance WHEN it happens;
6. File for a restraining order RO or TRO with the court which includes exparte protective orders until the hearing date;
7. Obtain sworn declarations from any person who has witnessed this person stalking you to include in your application for your restraining order.
(This sworn declaration must say "I declare under penalty of perjury under the laws of the State of [insert name] that the foregoing is true and correct.)
The person must provide their full legal name, address, telephone number and date of birth in their statement.
Include all of your documentation with your application for the restraining order.
Bring any witnesses you have to the hearing.
If the judge denies your petition, continue to document everything then refile, making sure to include the case number for the previous case in your declaration.
Under other orders, you can requestion the judge to order your stalker to provide the court with proof that he has sold or turned in his firearms to law enforcement to hold for him until the order expires.

Trying to convict someone of stalking in court is a hard thing to do but it can be done. If the guy comes over everyday try to video tape it, try to get his reasons why he is there. And when you contact the police make sure you let them know that this guy scares you and you are afraid for your life and show them your evidence. then it is up to the police to take it from there. if anything else they should at least let the guy know that they are watching him.

well, unfortunatley, it isn't a matter of someone following your every move that warrants legal action...it's whether they've threatened to do you harm. so, if they haven't threatened to harm you, you're probably out of luck with the police. if they HAVE threatened you, then you'll need proof, such as emails or recordings of phone calls or maybe witnesses...my ex-boyfriend was kind enough to leave a message on my answering machine threatening to kick my a$$...so it was very easy to provide proof (what a dumb-a$$ he was...no wonder we broke up!)
however, if you happen to be somewhat famous, it's quite easy to get a restraining order...
