This happened about 10 miles from where I grew up. LOL

ABBOTSFORD, Wis. — Police cited a legless man and his friend with drunken driving _ the third and second such arrests for the men, respectively _ saying the disabled man was at the wheel while his friend worked the pedals.

Harvey J. Miller, 43, was steering the 1985 Chevrolet truck and Edwin H. Marzinske, 55, was operating the pedals when they were pulled over Aug. 18, according to a police report.

Miller, who was sitting in the driver's seat, told officers he had too much to drink, but argued he wasn't really driving since Marzinske was on the brake and the accelerator, police said. Marzinske was arrested on the same charge.

Miller received a citation for a third drunken driving offense, and Marzinske his second. Both also were cited for driving after their licenses had been revoked.

Any police have comments? How long would the paperwork on this one take?!

Both men were in control of the car. At least one of them (probably both if I had to guess) were impaired.

There is a law in North Carolina that deals with Impaired Instruction. I'm sure some drunk got this bright idea but I haven't seen it yet. Anyway it covers someone letting their kid drive with a learners permit while they (the parent) are drunk and sitting in the passenger seat. The learners permit requires a licensed parent or guardian to ride with the permit holder.

I have arrested several drunks who were out driving around with their kids in the car.

Happens a lot belive it or not.

If you follow the law to the letter, you can be asleep in the back seat with the keys under the seat and still get a DWI...all you need is to be in control of the vehicle and be impaired. (Due to the possibility that you wake up and decide to drive.)

Many times there has been a "sober person" in the passenger seat, with the "drunk person" driving. When they get pulled over they attempt to switch seats...in full view of the officer walking up. Both then get DWI's..pretty funny actually.

I've never heard, or handled a situation like this, but looking at it logically, it would be like processing two DUIs at once. Obviously taking twice as long, and being very precise on the observations, and comments made.

Thanks for sharing. Sounds like and interesting case.

My ex-husband was arrested for drunk driving when he had pulled over to the side of the road and fell asleep. He had the car running and foot on the brake. Yeah he was drunk before he fell asleep but was not moving when the police found him.

Of course it didn't help that he punched the cop for waking him up. LOL And this was in Green Bay, WI.

The case will drag depending upon the availability of the documents. The period would be from three months at least.
