A while ago my daughter came home from her weekend at her dad's house and literally explained to me how her dad makes "blunts" with "weed". My daughter is 5yrs. old. No 5 year old should know what weed or blunts are. She also stated that he smokes it in front of her with his friends. We are going to court on this coming friday. She also watches rated R movies over there which she named off for me (Kill Bill, Black Christmas & House of Wax). I have seen none of these movies, but am 99% sure that it is nothing a 5 year old should be seeing.

You can go back and demand changed to the visitation rights with this in mind... he can be limited to "supervised visitation" only. In other words, you will take your daughter to some facility and an officer has to stay with the daughter and dad for the duration of the visitation.

Although child visitation is freely given, it can also be limited by the court for misconduct by a spouse. If you are the custodial parent and your spouse poses a threat of harm to your children, is abusive to them, or acts irresponsibly, you can petition the court to limit your spouse's child visitation rights, to require a third-party to supervise all visits, or in extreme cases, to deny all child visitation rights. The court can also impose conditions on continuing child visitation rights, such as requiring a substance impaired spouse to undergo alcohol or drug addiction treatment. The courts typically have broad discretion in crafting appropriate child visitation provisions.

Since you are going to Court this Friday, it definitely should be brought to the judge's attention. However, I don't believe that he will take away the father's visitation (they do not want to separate child from parent unless absolutely necessary), but I can definitely see supervised visits be required.

I don't think a judge could, unless he has sufficient reasons to believe that your daughter is in danger in the presence of her father. And again what you mentioned could be easily refuted by the father. A judge will not believe a 5yr old kid. She is still too young to understand what is going on and just by naming a few shows does not mean a thing.

take care
