i have heard that if you send a certified letter to the 3 credit agencies that says you want proof that you owe a certain company the amount they say you owe and they are unable to provide proof withen 30 days that they have to take this off of your credit... if this is true how does this work? (how can they do that) ....

also if you are called by a collections agency and they ask you if your able to pay a dept and you tell them you cant right now....but are working on it, and they say "nevermind ill just sugest they sue you" and then hang up, what can i do about this? i have disputed some of this since we didnt owe the amount they are saying we owe, and everytime i call them or go to them or anything asking for proof that we owe this much money they have failed to show it. i even went to the main managemnet company of the apartment complex. ....

Is it on your credit report? You can dispute errors with all three credit bureaus (doesn't need to be certified letter). The credit bureaus contact the creditor who reported the item and ask for verification. The creditor responds that it's correct. That's the extent of the credit bureaus responsibility.

You need to send a letter (certified mail, return receipt) to the creditor requesting a detailed accounting of the debt. Include that you dispute the debt and want proof.

If the creditor fails to respond to you within 30 days, you can do a second dispute with the credit bureaus, include a copy of your letter to the creditor. That might get it removed from your credit report.

However, the creditor can take you to court.

Well given the fact that it was an apartment complex the rules do change a little.

How much do you owe has alot to do with it too, if you owe less than $500 they cant sue, well let me correct myself, They could sue you but, They will be loosing a lot of money to do so, and usually an apartment complex it too busy to even bother. They do however contact the credit Bureau, and it will also come up on future landlord refrences, which is not good. You should be able to go back and request a copy of your tenant file. You have legal rights that protect you!!! so if they dont give you the info you need, then u can Sue them!! and eventually get it removed from your credit Report!!

Hi. You can actually call one of the credit bureaus to get things moving faster. I'm sorry I don't have a number handy.

And don't worry about the apartment complex. If they cannot prove that you owe money, then what the heck are they charging you for???

It is called a debt validation letter. The link I provide describes how to write one.

Do not talk to a collector over the phone. They will lie through their teeth. Get everything in writing before sending ANY payment.

Get yourself a lawyer. He'll have a better understanding of the laws and policies surrounding this. He'll let u know if you're in a favorable position for this lawsuit or not. *see what i did there, sexist remark by saying "he", not intentional :D*
