The 14th amendment was enacted post civil war to reflect that freed slaves were citizens by birthright.It does not state that a person illegally crossing our border then giving birth has those same rights.The slaves were brought here against their will.

I don´t know why us citizens are saying that Mexico does not give the same constitutional rights as the USA. If your wife gives birth while in Ensenada your child will be a mexican citizen (a dual citizen). From the mexican constitution:

Article 30 - Mexican nationality is acquired by birth or by naturalization.

a) Mexicans by birth are:

I. Those born in the territory of the Republic, no matter what the nationality of their parents is;

II. Those born in foreign territory, sons or daughters of Mexican parents born in national territory, a Mexican father born in national territory, or a Mexican mother born in national territory;

III. Those born in foreign territory, sons or daughters of Mexican parents by naturalization, of a Mexican father by naturalization, or of a Mexican mother by naturalization;

IV. Those born on board Mexican ships or aircraft, whether military or civil.

b) Mexicans by naturalization are:

I. Foreigners who obtain a naturalization document from the Secretariat of Relations.

II. The foreign woman or man who marries a Mexican man or woman, who has or establishes residence within national territory, and complies with the various requirements that the laws in effect specify.

How can be possible that they think only in the USA those have born are citizen??????

Every people who born in Mexico has the right to be a mexican citizen, if the parents are foringers, the person can decide to have double nationality.

Both Mexico and the United States practice Jus Soli and Jus Sanguinis (Right of the soil and Right of the blood respectibly). This means that your child will be able to have both American and Mexican citizenship. So Megan and that other guy were both right.

You are right on. Why should we pay for illegal hispanic babies when we have insurance woes of our own. Why cannot Vincente Fox pay for our step-children we are required to house and feed and pay medical expenses for their illigitimate kids. As Texan will I be considered a American-Mexican if we have reconquista and our land becomes another wasteland like mexico?

No the Mexican government does not have anything like our 14th Amendment that gives citizenship just by being born in their country.

yes, because you are in mexican territory....it works the same way as if a mexican pregnant woman gives birth while on chicago the baby would be american citizen....

MEXICANS BY BIRTH ARE:

· “Those that are born in the territory of the Republic, whatever the nationality of their parents.”

· “Those born outside Mexican territory of one or both parents that were born in Mexico. “

· “Anyone born outside of Mexico of one or both parents that are naturalized Mexicans”

· “Those born on board Mexican ships or aircraft.”

This means that anyone born in Mexico has Mexican nationality by the simple act of being born in Mexican territory. Anyone who has one or both parents born in Mexico is a Mexican national. There is a simple procedure for verifying this nationality. Anyone born in the U.S. that has at least one Mexican parent has dual nationality in Mexico.
