If you each had children that you could claim as dependents and you did not live together anytime after June 30th that should be fine. You may have issues about support and maintaining a household but if those are clear I would not worry.

It was probably wrong. The only way you could legally do that is if you didn't live together at any time after June 30 of that year, and each of you had a dependent child living with you in that home and you were paying over half of the expenses to keep up the respective home.

Otherwise, the person (or both of you) who don't meet the above situation needs to file an amended return correcting your filing. It would be a good idea to do it as soon as possible, before the IRS contacts you about your illegal filing.

If you both had a child that you supported in the homes then there's nothing wrong with filing as head of household. But if you don't have any kids, then you both need to file amended federal and state returns, and change filing status to married filing separately.

You can't, you fill Married filing jointly or Married filing seperately.

Head of Household is for single parent homes. Only one of the parents can file, whoever the child/children live with.

So long as you dont get caught. *smile* tax laws change like the weather, its really tough to tell. I would call a tax company like H and R block. ask them, they might let you know.
