Hi - Can anyone tell me if a house can be sold when there is a charge on a property? Also is it the solicitors duty to do a search to see if there are charges? Any help and advice would be appreciated. Thanks in advance

Charges do not stop a house being sold. They only affect what happens to the proceeds of the sale.

The solicitor must determine if any charges exist. The purchaser's solicitor will require confirmation that all charges have been settled in order that the new owner may be registered with the Land Registry.

Once the property is sold the solicitor has to repay the money owed to the chargeholders in order and any balance is then returned to the vendor.

it is the solicitors duty to drag out the process for as long as possible, charge you for the most simple of internet searches and to turn your hair grey and send your blood pressure sky high.

and they charge you for the pleasure of it.
