Who qualifies to collect unemployment?

Question

I live in MA and wondering who qualifies for unemployment benefits/pay? I thought it was just for people that were laid off from their jobs, or when their company went out of business. But some say you can still collect if you were fired from a job. Does anyone know the guidelines? or who can NOT collect.

To give more info I am employed I have not been fired, I was asking a general question because there are a few people with my company that may be fired. (About 3 or 4)(good example boss with the hissy fit lol) People wanted to be prepared and seeing here in MA lately if you find a decent job you need to wait 4, 5 sometimes six weeks for the whole interview process.

The only way you cannot collect unemployment is if you were fired for Cause or you quit the job. Cause is you had a fight with another co-worker on company property, theft, drinking on the job or drugs. If you were "let go" because you were unable to perform your job duties or you were not working out or the company laid you off or closed, you have the right to collect unemployment. If they file with UE then it's Unemployments job to notify the employer to find out why. If they determine the employee was not let go for Cause then they will qualify for unemployment benefits. However, the company can fight the unemployement. I worked for a company that fired the building engineer because they heard he was bad mouthing the company to building tenants. He filed for unemployment and got it, however, the company appealed his UE and won, which meant he had to pay back all the money he received from UE.

You need to visit your local unemployment office to get the details about this. However, in most cases getting fired disqualifies you. Non-profits with fewer than 3 employees don't have to participate in providing unemployment benefits and some employers are exempt. In either case, it's worth trying for because every circumstance is different and there's always loopholes in things but you'd be better off not collecting and just getting a job at Kmart or McDonald's restaurant or doing something part-time as a contractor until you find the right position.

You can collect if you lost your job through no fault of your own. If you did not do anything to be fired for you can collect if the hearing officer takes your side. I say go to them and ask. Each state is different and your ex employer will have to show why you were fired and it has to meet their reasons for cause to fire someone. They can't just fire you without reason, there is a hearing and if they don't show up to contest it, you may win automatically. You'd be better off going to the Employment office and discussing it with them. Good luck. You also have to have enough working quarters paid into the system and they can tell you that also.

They have to work a certain amount of hours and days. Also they can submit but it does not mean they can collect. Usually if your company gets contacted then you go to a small hearing where it's decided. If you have documented evidence on the employees of why you had to fire them. That will help your case.

Anyone can file for it, but it does not mean they will win it.

If you were fired because the boss had a hissy fit
But you had not done anything illegal , you can collect .
Or if you can justify resignation because there was abuse or harassment that had negative health implications for you . . .
But each state's rules vary , so check with your UI office for the fine print in your state .
